The transfer obtained may or may not determine the three-year bond at the property school. It depends on the preferences expressed in the question.
A reader writes us:
“I have a question about the transfer request: three years ago I applied to be transferred to a specific IC in Bergamo; the following year, for personal reasons, I reapplied and obtained the transfer to Modena (without specifying the preference for any IC in the city). Can I now request an additional transfer? “
The teacher who is satisfied in the transfer request will be able to participate again in the mobility for the following school year only if he / she is within the conditions established by the CCNI that exclude him / her from the three-year stay at the school of ownership.
Three-year bonus, when applicable
As Article 2.2 CCNI on mobility clarifies, “The teacher who obtains ownership of a school by voluntary request, both territorial and professional, having expressed a specific school request, will not be able to request mobility during the following three years. In the case of mobility obtained in a school institution during phase I movements through the expression of the sub-municipal district code, the teacher will not be able to submit a request for voluntary mobility for the next three years. This restriction operates within the same municipality also for movements in phase II from the common place to support and vice versa, as well as for professional mobility.“
The three-year restriction, therefore, applies in the following cases:
- Teacher satisfied in an analytical preference (specific school) for both territorial mobility (transfer) and professional (transfer of chair and change of role)
- Teacher satisfied with the synthetic preference in the municipality of ownership both due to the change of the chair and the change of role as well as for the transfer to another type of position (support to common position and vice versa)
Three-year bonus, when not applicable
The three-year restriction does not involve teachers satisfied in the mobility request, if they obtain the requested movement in a synthetic preference in a municipality other than the one they own or in a synthetic preference in the province.
Furthermore, the three-year restriction does not apply to teachers who benefit from the priorities established in art. 13 of the CCNI, in the event that they have obtained the degree in a school outside the municipality or sub-municipal where precedence corresponds.
Likewise, teachers who have been transferred ex officio or with conditional demand are not affected by the three-year bond, even if they are satisfied with an express preference.
Conclusions
Our reader, who has been transferred to a school located in a municipality other than that of ownership as a result of a synthetic preference in the municipality, is not affected by the three-year bond and therefore may submit the transfer request that interests her for the next school year.
