What can and cannot be done at Christmas? Can I go with friends on New Years Eve? What has changed since December 24? There are many questions after the Christmas decree, with so many responses from the Government and regulations to be respected in the coming days, in addition to those already formulated in the past.

What awaits us will be ten days in the red zone, but with exceptions and four in the orange zone, again with some small concessions. In the last hours the Government has updated the Faq but it must be clarified immediately that there are no changes regarding the Christmas decree of December 18. A solid point is to return to one’s residence, domicile or home, which always remains a legitimate reason to move. As well as it will be possible to move for proven reasons of work, health or needs always possible, without distinction between days and hours.

The fines do not change: the administrative sanction for those who do not respect the prohibitions ranges from a minimum of 400 euros to a thousand euros. The penalty increases to one third if “the offense occurs through the use of a vehicle.”

That’s when self-certification is needed

Red zone, on what days? What can be done

The red zone is proclaimed throughout the national territory from December 24, 2020 to January 6, 2021, except on December 28, 29 and 30, 2020 and January 4, 2021, when the orange zone will be in force. On December 24, 25, 26 and 27, the red zone decided by Legislative Decree December 18 comes into force: restaurants, bars and shops close all day except groceries, pharmacies, parapharmacies, tobacconists and those of primary products needed; it will not be possible to leave the house except for reasons of necessity and urgency, but two people will be allowed to go out once a day to visit family or friends (but must return home before 10 pm); children under 14 years of age are not within the limit of two people and those who live in municipalities with fewer than 5,000 inhabitants may travel within a radius of thirty kilometers; these movements can be done with self-certification.

These days you can go to the hairdresser, while the beauty centers are closed. Individual motor activities and outdoor sports can be carried out. You can buy take out until 10pm. M., But do not eat it near the restaurant, and order food delivery. In short, in the red zone:

  • movements are allowed only for reasons of work, health, necessity and these include assistance to a non-self-sufficient person; you can return to your residence, domicile or domicile where you usually meet your partner and also to second residences (see edit at the end of the article); you can go shopping and mass, as well as to the pharmacy and tobacconist;
  • you can go to other people’s houses (in two, but children under 14 are not counted in the total) with movements within your own municipality;
  • The bars and restaurants close from Christmas Eve to reopen on January 7; only home delivery or take away service is allowed before 10 pm Autogrills on motorways and bars at stations and airports remain open;
  • The open businesses are: supermarkets, groceries, hairdressers, barbers, tobacconists, pharmacies, parapharmacies, bookstores, newsagents, florists, toy stores and sportswear stores, tobacconists and hardware stores, laundries and pet stores;

Orange and red zone: the rules from December 28 to January 6

In the orange zone, in force from December 28 to 30 and January 4, shops open until 9:00 p.m. while bars and restaurants are closed (but there is a yes to bring food until 10 p.m. and home delivery). Also on these days it will be possible to visit family and friends (but no more than two people) in your own Region. You can leave your municipality (which does not exceed 5,000 inhabitants) no later than 30 kilometers. In summary, in the orange zone:

  • It is forbidden to circulate from 22 to 5 unless reasons of work, health or urgency and necessity are demonstrated, accredited by self-certification;
  • travel from one municipality to another and from one region to another is prohibited;
  • shops are open, bars and restaurants are closed.

Anyone who does not respect the prohibitions introduced can be fined: the fine ranges between 400 and 1,000 euros, but it is reduced if paid within five days. Police checks can also be carried out after the on-site check. In case of displacement considered out of the norm, the police can order the return to the place of departure of those who have not respected the norms. In case of dispute of the fine, you can appeal to the prefect. Participation in religious services is allowed. On Christmas Eve, the CEI anticipates the services to allow the return home before 10 pm The invitation is to go to the church closest to home and bring the self-certification.

Movements between small towns

Leaving aside the clarifications, what was not understood (nor known) was the possibility of moving between small municipalities even outside their own region, on orange days (December 28-29-30 and January 4), provided that are made within 30 kilometers and not towards the provincial capital. The repeal affects 10 million Italians: many of them live in municipalities with fewer than 5,000 inhabitants. For the rest, some doubts were resolved, which, however, had already been debated in recent days. The possibility of always returning to one’s residence has been confirmed.

Also for Christmas and New Years, the rules of the red zone and the orange zone already in force will apply. With a new feature: on holidays, a maximum of two people (minors and the disabled are not included in the count) to the homes of friends and family will be allowed.

Will I be allowed to visit friends or family during the holidays?

The answer to this question varies depending on the days, the place of departure and the destination of your trip. Until January 6, 2021, all movements are prohibited, even to visit friends or family, that involve leaving the Region in which you live or in which you have residence.

Between December 24 and January 6, current provisions establish that on holidays and the eve of holidays (December 24, 25, 26, 27 and 31 December and January 1, 2, 3, 5 and 6) it will be possible, only once a day, to travel to visit family or friends, even other municipalities, but always and only within the same Region, between 5 and 22 and up to a maximum of two people. In any case, the person or two people who move can bring with them children under 14 years of age (or other children under 14 years of age over whom the same people exercise parental authority) and disabled or non-self-sufficient people who live with them.

On December 28, 29 and 30 and January 4, it will be possible to circulate freely, between 5:00 and 22:00, within the Municipality itself, so it will also be possible to visit friends and family within these hours and territorial spaces. On the same days it will also be possible, once a day, to travel to visit family or friends, in a Municipality other than yours, but always and only within the same Region, between 5 and 22 and within the maximum limit of two people . The person or two people who move may bring with them children under 14 years of age (or other children under 14 over whom the same people exercise parental authority) and disabled or non-self-sufficient people who live with them;

Also on December 28, 29, 30 and January 4, residents of a Municipality of up to 5,000 inhabitants may move freely, between 5:00 a.m. and 10:00 p.m., within 30 km of the limit of their Municipality (therefore possibly also in another Region), with the prohibition, however, of moving to the provincial capitals: consequently, it will also be possible to visit friends and family within these hours and territorial spaces.

So in the red zone I can’t go to the houses of friends and family?

In the last decree, the derogation was introduced by which during the holidays and the days before the holidays between December 24, 2020 and January 6, 2021 in all Italy, you can move (once a day and at most two people) to the house of friends and family, as long as it is within the same region from which we depart. In short, the trick is there: a couple can spend Christmas or New Year’s Eve with another couple of friends or family, as long as it is within the parameter of the time slot (between 5 and 22) and only once a day. (Therefore, if we are talking about Christmas dinner, for example, stay to sleep at a friend’s house) Everything as long as this is within the same region from which we started. But is it possible to go to lunch with one family member and have dinner with another? No, a maximum of one trip per day is allowed.

My parents, elderly but in good health, live in a different region than mine. Can I go visit them during the holidays?

No, in the period between December 21 and January 6 these movements are prohibited.

Can I visit a family member who, despite being self-sufficient, lives alone, to alleviate his loneliness during the holidays?

Until today to December 23, this movement is only allowed as long as you remain within your own Region, from 5 to 22 From December 24 to January 6 it will be possible, once a day, to travel to visit family or friends , only within the same Region, from 5 to 22 and up to a maximum of two people. In any case, the person or two people who move can bring with them children under 14 years of age (or other children under 14 years of age over whom the same people exercise parental authority) and disabled or non-self-sufficient people who live with them.

Can separated / adoptive parents travel between December 21 and January 6 to go to different municipalities / regions or abroad to spend the holidays with their minor children, in compliance with the provisions of the judge or the agreements with the another parent?

Yes, as already specified, these movements are among those motivated by “necessity”, so they are not subject to limitations. In the case of trips to / from abroad, in any case it is necessary to consult the corresponding section of the website of the Ministry of Foreign Affairs and International Cooperation to obtain information on the specific health requirements related to the country from which you come or are must go out.
