Whoever fails to comply with the rules of the decree approved yesterday afternoon by the Council of Ministers on the occasion of the Christmas holidays and the new year is sanctioned with the administrative sanction of the payment of a sum to Euro 400 to Euro 3.000. Which increase up to 4000 euros for those who are stopped by the police in a vehicle.
If the breach of the aforementioned measures occurs due to the use of a vehicle, the penalties are increased by up to one third. Article 3 of the provision published in the Official Gazette provides for it. The sanctions are the same as those provided for in article 4 of the decree-law of March 25, 2020, n. 19, converted, with modifications, by law May 22, 2020, n. 35.
So be careful with fines: if at home you can only stay with cohabitants and two guests (plus children under 14 years old), no more than two people are allowed in the car. The movements are generally allowed for return to residence, home, reasons of need, work and health. Here are the exceptions.
But what can be done and what is prohibited?
As we have explained, the exemption for lunches and dinners One of the parties consists of the possibility of hosting two diners who do not live together, in addition to children under 14 years of age and the disabled, who can travel even with prohibitions to reach family, friends and closest relatives in private homes. But this “once a day” and “to a house”, obviously in the same region. In the provision there is also an exception for small municipalities: it is possible to travel from those with less than 5,000 inhabitants, but at a maximum distance of 30 kilometers and in any case not to go to the provincial capitals.

It will not be possible to organize parties or meetings with dozens of family and friends, but the repeal in the Decree gives the green light to visits during the entire period of the parties for two people who do not live together and those under 14 years of age can accompany their parents. Family ties are not required (in recent days there was talk of limitations in the first and second degree) and encounters between friends are not prohibited.
Therefore, between December 24, 2020 and January 6, 2021, a family member or friend is allowed to visit during these days without leaving the region and with the limit of having to return at 10 p.m. or later 5:00 a.m. to go to a single at home during the day (so there is no family tour) and that there are no more than two to go and wish them well.
In private homes there are no prohibitions and police controls are impossible unless a complaint arrives. Therefore, controls will focus on travel.
Limits for traveling on red days
In Red zone proclaimed from December 24 to 27, from January 31 to 3 and on days 5 and 6 it is forbidden to move unless there are reasons of work, health or need and these include assistance to a non-self-sufficient person for whom only one person can move with minor children. In these cases, self-certification is required. It is always allowed to travel to return to one’s residence, domicile or home where one is usually with the partner, but also here self-certification will be necessary. You can go out to go to mass or do physical activity.
Displacement to second homes within the same Region will always be possible throughout the holiday period.
Limits for traveling on orange days
In orange zone proclaimed from December 28 to 30 and January 4, it is allowed to move within the municipality itself but not outside it or the region (the prohibition to leave the region will start in any case from December 21). Self-certification will be necessary if you have to move outside your municipality or region for the three usual reasons of work, health, demonstrated need and urgency. Unlike the red zones, in the orange zones you can move freely within your municipality, as required by the above Dpcm, but only from 5 to 22. At night, however, you have to carry the self-declaration with you.
No lunches in the restaurant or snacks
Bars and restaurants will be closed from Christmas Eve until January 7. Delivery service and take away food are still allowed before 10pm. The only exception are the restaurants and bars on the motorways in the stations and airports that will remain open.
You can go shopping
Supermarkets will always remain open even on “red” days except Christmas Day and New Year’s Day. On orange days, all kinds of shops can be opened, with continuous and extended hours until 9:00 p.m. to avoid crowds.
