172, which takes all of Italy to the red and orange zone from December 24 to January 6 for a 2020 Christmas in closing, was approved by the Council of Ministers and published in the Official Gazette. The red zone is proclaimed throughout the national territory from December 24, 2020 to January 6, 2021, except on December 28, 29 and 30, 2020 and January 4, 2021, when the orange zone will be in force. However, in the decree there is a derogation that will allow two people to travel once a day to visit friends.

Decree Law December 18: Conte closes Italy for 10 days at Christmas 2020 (with derogation for family and friends)

The Christmas decree law of 2020 was approved instead of a Dpcm because the rules now superseded by those in force since December 24 had been approved with another decree law (December 2 n.158) and, therefore, needed a source of law superior to the ministerial decree for the procedure to be correct. In the decree law, the days in the red zone have become ten and four in the orange zone. This is the text of the decree law, which consists of a single article and three paragraphs:

Art. 1 Urgent measures for the Christmas holidays and the beginning of the new year

1. Without prejudice to the provisions of article 1, paragraph 2, of decree-law December 2, 2020, n. 158, the measures referred to in article 3 of the decree of the President of the Council of Ministers of December 3, 2020 are applied throughout the national territory on public holidays and prior days between December 24, 2020 and January 6 from 2021; On December 28, 29, 30, 2020 and January 4, 2021, the measures referred to in article 2 of the same decree of the President of the Council of Ministers of December 3, 2020 are applied, but they travel from municipalities with a population of not more than 5,000 inhabitants and for a distance of not more than 30 kilometers from the relative borders, excluding in any case travel to the provincial capitals.

During the days between December 24, 2020 and January 6, 2021, it is also possible to move to a single private home, located in the same region, once a day, in a period of time between 05:00 and 22:00. , and within the limit of two people, beyond those who already live there, in addition to those under 14 years of age over whom they exercise parental authority and disabled or not self-sufficient people who live together.

2. During the entire period referred to in paragraph 1, the measures adopted by decree of the President of the Council of Ministers in accordance with paragraph 1 of article 2 of the decree-law of March 25 remain valid, for everything not provided for in this decree. 2020, no. 19, converted, with modifications, by law May 22, 2020, n. 35.

3. Violation of the provisions of this decree and those of Decree-Law December 2, 2020, n. 158, is sanctioned in accordance with article 4 of the decree-law of March 25, 2020, n. 19, converted, with modifications, by law May 22, 2020, n. 35.

The decree opens the possibility of the visit of two non-cohabitants, excluding those under 14 years of age from the count, as well as the possibility of moving between small towns with fewer than 5,000 inhabitants on orange days. The curfew is also confirmed at 10 p.m. The text certifies the possibility of moving during the entire period between December 24, 2020 and January 6, 2021 to other private homes once a day. No reference is made to first and second degree relatives, so according to the decree the repeal is valid for both family and friends. Red and orange zone in Christmas 2020, what you can do and not do: the calendar of prohibitions and exemptions for family and friends

What changes from red zone to orange zone

The change from orange to red zone changes that in the second zone, citizens can move freely and all stores are open, not just food and basic needs. Bars and restaurants are closed in both areas. There are 10 days in which the red zone will extend to all of Italy: December 24-25-26-27 and 31, January 1-2-3-5 and January 6. In the red zones it is “forbidden to enter and leave” both between counties and between municipalities and within them “except for proven work needs or situations of need or for health reasons.” However, it is always possible to return to your home or address.

On the other hand, it is allowed to carry out both physical activity, “individually” and “in the vicinity of one’s own house provided that the distance of at least one meter is respected and with the obligation to use protective equipment”, as well as sports , but even this only individually and “exclusively in the open air”. The supply stations for closed activities have the following funds: “A non-refundable subsidy is recognized, up to a maximum of 455 million euros for 2020 and 190 million euros for 2021” to restaurants, bars and canteens that have suffered damages due to anti-Covid regulations. The contribution is granted to those who have already benefited from the provisions of the relaunch decree and cannot exceed € 150,000.

The delay in the press conference of Prime Minister Giuseppe Conte, according to sources from Palazzo Chigi, was due to waiting for the details of the provisioning measures developed by the Mef for the decree on the Christmas squeeze. The President of the Republic, Sergio Mattarella, signed and promulgated law 12/18/2020, conversion into law, with modifications, of the decree-law of October 28, 2020, n. 137, which contains new urgent measures in terms of health protection, support for workers and companies, justice and security, related to the epidemiological emergency of Covid-19, the so-called provisioning decree.

The working days of December 28, 29, 30 and January 4 will be considered in the orange zone. “These days you can only move within your own municipality. But here we have to accept an invitation from Parliament to get to know the smaller municipalities: you can move between those with less than 5000 inhabitants and within a radius of 30 kilometers, but not in the provincial capitals so as not to contribute to the overcrowding of large cities ” Conte explained during the press conference. Then recalling the need for self-certification: “We do not enter the homes of Italians, the decree is conceived as a limit to the movement of people. As we are in the red zone, we intervene to give strong limits to circulation. We leave with self-certification.
