“The Piedmont Region measure clearly falls within the category of more rigorous similar measures possibly envisaged for these territories, that is, for the Regions located in the so-called orange zone, in full harmony with the aforementioned in peius exception in which the system of the sources of the emergency phase is based “. Thus, the TAR of Piedmont motivated the sentence with which it had already denied the suspension requested by a group of parents with respect to the ordinance with which the Region kept the second and third middle schools closed despite the transition from the red zone to the orange zone.
“The Region – the judges continue – by giving broad reasons with reference to the trend of the epidemiological situation in the Piedmont area, has decided to exercise its power of ordinance in matters of hygiene and public health by ordering the application of a more restrictive measure than to the precautionary regime dictated by the authority of the central government, precisely the continuation of distance education for lower secondary schools (second and third year) ”.
The TAR thus confirms the use of distance education. Therefore, although in the yellow zone, the second and third grade and high school students do not return to the classroom: thus the text with which the appeal is annulled presented by the lawyer Emanuela Antonella Barison and signed by 98 parents has been canceled and educators.
Piedmont is preparing to resume classes in middle and high schools beginning January 7 and staggering the hours of entry to classes in two shifts: 8 am to 1 pm and 10 am to 2 pm or 3 pm.
