Dpcm, from nanny grandparents to condominium assemblies: the new rules depending on the color of the Region

A few days after the last Dpcm establishing three different risk bands within the country (yellow, orange and red), the government finally intervenes with clarifications on the new measures adopted. As in the past with the other measures, the Frequently asked questions, specifically the useful questions and answers for citizens to clarify their ideas about the behaviors to be maintained at least until December 3.

MEASUREMENTS

Beyond the best known measures, such as curfew from 10 to 5 in the morning with a lot of obligation of self-certification – the questions also take stock of aspects related to the daily life of citizens and perhaps misunderstood Dpcm in the hand. For example, the executive wishes to point out that both yellow areas (the whole country in practice), since in the orange and red areas “the transport, delivery and assembly of furniture” is allowed because “they are part of the proven work requirement that justifies the displacement”. However, given the time of year, with Christmas almost upon us, the Prime Minister also decided to clarify his position regarding the traditional Christmas markets. Not only. Controversial aspects such as physical activity outdoors or walking the dog were also clarified. And about aspects that interest parents. For example, is it possible to leave children with grandparents on the way to work? Or can a separated parent move, even from one municipality to another in the orange or red zone, to visit his youngest child? In practice, many questions related to the thousand facets of life in the country, with activities perhaps left until today to avoid high fines, have found their own answer.

Grandparents-babysitter: can parents leave their grandchildren?

YELLOW There is no real prohibition, but it is “strongly discouraged”. In any case, for the text, parents can accompany or pick up their children from their grandparents on their way to work.

ORANGE The same principles apply. The FAQs, however, stress that this solution should be used as little as possible. “Only in dire need, if both parents cannot stay with their children.”

ROSSA The same goes for red areas. It is important to take only the route strictly necessary to reach them and go to work.

Street vendors: do they stop at the stalls for Christmas?

YELLOW Traditional Christmas markets are banned across the country. “These events – we read in the Faq – are assimilated to fairs”, explicitly blocked by the Dpcm.

ORANGE Obviously, they are also prohibited in this case even if “they are carried out outside of ordinary commercial activity in spaces dedicated to stable or periodic market activity”.

ROSSA Needless to say. In the areas most affected by the measures, at least until December 3, there are no Christmas markets.

Condominiums: Meetings in presence?

YELLOW The Dpcm allows condominium meetings to be held in presence. However, this time also “it is strongly recommended that the meeting be held remotely.”

ORANGE Even in Puglia and Sicily (currently the only two regions in scenario 3) these are allowed.

ROSSA Ok here too. However, in all areas and events, “it is important to respect the provisions on social distancing and the use of personal protective equipment.”

Separated couples: can I go with my children?

YELLOW Yes. Trips to reach minor children with the other parent or in any case with the adoptive parent, or to take them with you, are also allowed between municipalities in different areas.

ORANGE Permitted. But as for yellow, these movements must be carried out in any case by choosing the shortest route.

ROSSA Yes. The Faqs, however, specify that it is necessary to comply with all the health requirements and the procedures provided by the judge with the separation or divorce measures.

Shopping: can I buy in another municipality?

YELLOW “Yes, as long as both municipalities are in the yellow zone.”

ORANGE Yes, it is allowed but only and exclusively if the goods to be acquired are not available in your municipality and therefore it is essential to move.

ROSSA The same principles apply as for the orange areas. “It is possible to move,” he says, “where the municipality does not have stores, or it is necessary to urgently buy essential items not available in the municipality of residence or address, moving is allowed.

Pets: can I go out with my dog?

YELLOW This is an aspect considered very controversial during the last confinement, for which the government has decided to clarify. If possible. Even during curfew hours, that is, between 10 p.m. and 5 a.m.

ORANGE The same indications apply as for the yellow areas. “Without crowds and maintaining a distance of at least one meter.”

ROSSA Yes also in this case. However, it is not possible to accompany the pet to the vet for routine check-ups. Only emergencies are allowed.

Cars: in the car only with partners?

YELLOW No, it is also allowed to travel with people who do not live together “as long as the same precautionary measures for non-regular transport are respected.” That is, with the driver only in the front of the car and a maximum of two passengers for each row of rear seats (mask required).

ORANGE Identical indications also for Sicily and Puglia.

ROSSA Also in this case it is possible to move with non-partners (but a self-certification is needed for all).

Physical activity: can I continue jogging?

YELLOW Yes, in terms of walks, from 5 to 22 hours.

ORANGE The same principle of the yellow areas also applied in this case.

ROSSA Physical activity outdoors, including walks, is only allowed if done individually and close to the house. It is mandatory to respect the distance of at least one meter from any other person and to use personal protective equipment. Meetings are always prohibited.
