Many and risk of imprisonment for those who violate the rules contained in the new Dpcm anti-Covid. But let’s go in order. The new decree comes into force today, Friday, November 6, with progressive restrictive measures for the three areas into which Italy has been divided: yellow, orange and red.
- The regions of the red zone, very critical, are Calabria, Lombardy, Piedmont and Valle d’Aosta;
- Puglia and Sicily are within the orange area;
- The yellow area includes Abruzzo, Basilicata, Campania, Emilia-Romagna, Friuli Venezia Giulia, Lazio, Molise, Sardinia, Liguria, Marche, Tuscany, Umbria, Veneto, the provinces of Trento and Bolzano.
The measures and prohibitions in the red, orange and yellow zones
In the yellow regions it is forbidden to drive between 10 p.m. and 5 a.m. Shops close in shopping centers on holidays and before holidays, with the exception of pharmacies, parapharmacies, groceries, tobacconists and kiosks. Exhibitions and museums closed. Distance education is provided for secondary schools, face-to-face lessons remain for kindergarten, primary and secondary schools. Distance learning also in college, except for freshmen and lab activities. Written tests for competitions and suspended professional qualification tests, with some exceptions. For public transport: filling up to 50% except school transport. Stop gambling, gaming and video games. Closed swimming pools, gyms, theaters and cinemas, sports centers remain open. In the yellow zone there is a recommendation not to go to other homes.
Compared to the yellow zone, in the orange regions it is also forbidden to enter and leave from one region to another and from one municipality to another, except for reasons of work, study, health, need and to take advantage of services and activities not available in the municipality of residence. In these regions, bars and restaurants are closed 7 days a week, but can serve take-out until 10 pm There are no restrictions on home delivery.
New Dpcm effective today: what can and cannot be done with the curfew and during the day
In the red regions it is forbidden to move even within the municipality itself at any time, except for reasons of work, study, health or necessity. Shops close, except for food, pharmacies, parapharmacies, hairdressers, barbers and laundries. In public offices, I work in presence only for non-postponable activities. Otherwise, we are dedicated to smart work. Distance learning extends to second and third grade. University courses will be held remotely, with the exception of medicine with related practices. Written tests for competitions and professional qualification tests are suspended, with some exceptions. All sports competitions are suspended, except those recognized as of national interest by the Coni and the Cip. All activities in sports centers are suspended, physical activity near the house and individual sports activities are still allowed. Here, too, for public transport, filling up to 50% with the exception of school transport. Stop gambling, playing and video games.
The self-certification form for travel
Self-certification is linked to prohibitions: you can download it here. The movements in the red areas must be self-certified at any time of the day. The justification form for movements is the same that was already in use after the Prime Minister’s Decree of October 24 in regions where there were more restrictive ordinances than national measures and therefore where a curfew had already been ordered. . Self-certification will be required in case of police control to travel from 10pm to 5am throughout Italy and to travel within and between the red areas. Among the reasons that will allow the displacements are the proven labor needs; Health reasons and other reasons allowed by current regulations or by decrees, ordinances and other measures that define the measures to prevent the spread of infection.
The fines for those who do not respect the rules of the new Dpcm
As mentioned, fines are foreseen and there is also the risk of imprisonment for those who violate the rules contained in the new anti-Covid Dpcm. Those who do not have a valid reason to drive may in fact come across one fine of 280 euros, which can reach 560 in case of relapse. For those who violate the quarantine, a criminal complaint is planned with an arrest of three to 18 months, to which is added a fine that can range between 500 and 5,000 euros.
Being able to move will be self-certification required, downloadable from the website of the Ministry of the Interior. The reasons are the same as in the first months of the pandemic: work, health and need. If in the red zones shops, bars and restaurants must remain closed, in the yellow zones they may continue to operate but with precise rules. Raised blinds from 5 to 18, limited number of customers inside, maximum four people seated at the table and obligation to wear a mask except for drinking and eating. In case of infringement of the rules, the fines range between 280 euros and 560 euros. Restaurateurs also risk closure for up to five days.
On the other hand, there are no penalties for violating the recommendations contained in the new Dpcm. These include the invitation to move as little as possible even where, as in the yellow areas, it is still possible to move from one municipality to another or from one region to another.
