The provisions of the new decree apply from Thursday, November 5 to December 3, 2020, according to the draft of the Dpcm.

The government is examining the draft with the Regions that, among the observations made, are requesting homogeneous measures throughout the national territory. There is also a demand that epidemiological risk assessment be done in collaboration with regional departments. And then a decree is requested with compensation for the economic categories that will be presented together with the Dpcm, parental leave and conciliation and again tax exemption 2020-21 for all economic activities subject to closure measures.

“The provisions that squeeze and undermine the role and tasks of the Autonomous Regions and Provinces, placing each election and decision on the basis of the assessments made by the technical bodies by the Government, arouse strong perplexity and concern,” it reads in the letter sent by the president of the Conference of Autonomous Regions and Provinces, Stefano bonaccini, to Prime Minister Conte and Ministers Speranza and Boccia after the discussion on the scheme of the new Dpcm. The difference between the areas that fall in scenario 3 and those that fall in scenario 4 is that in the latter, movements “within the same territories” are also prohibited, therefore, at the municipal and provincial level.

Stores are also closed in high-risk areas. – Also stop the activities of stores and markets in the regions, provinces and municipalities of maximum risk. The draft of the Dpcm of article 1 ter provides for this. “Retail commercial activities are suspended, with the exception of the sale of food.” The measure also stops markets, all bar and restaurant activities (except home delivery and take-out allowed until 10pm) and sports activities. For the high risk areas, therefore, in the orange areas, the shops remain open but the bars and restaurants close. Also limited in these areas is “any movement by means of public and private transport in a municipality other than that of residence” except for work, study, health and needs reasons.

The draft of the new Dpcm foresees that on board the public means of local transport and for regional rail transport, “a load factor not exceeding 50 percent” is allowed; this with the exclusion, however, of “dedicated school transportation”.

Smart work at the highest possible level, both in the public administration and in the private sector, and differentiated entries of personnel. In particular, public administrations (except health personnel and those involved in the emergency) must guarantee “the highest possible percentages of agile work, compatible with the organizational potential and with the quality and efficiency of the service provided” and “with the established procedures by one or more decrees of the Minister of Public Function “. It will be the responsibility of each manager to ensure the highest level of smart work. The draft Dpcm also contains the “strong recommendation” for private employers to use agile work mode.
