May demonstrate in the square against the latest DPCM adopted by Giuseppe Conte? The answer is yes, always yes peaceably and in compliance with security measures to prevent the spread of infection.
After the end of the months of confinement, last May the possibility of demonstrating was introduced, with rules to respect regarding the social distancing (which must be guaranteed during the protest) and individual protection measures, mandatory for all.
Since then, the rules have not changed, however, there have been several episodes in which the demonstrations have turned into dangerous gatherings of people, often without masks, without taking into account the current regulations. Those who do not respect the anti-Covid measures during the protests take a risk heavy administrative penalties, sometimes up 1,000 euros. Here, instead, is the behavior to take during the demonstrations in the square to affirm their own ideas without “going to the wrong side.”
Demonstrate without risk of sanctions: all the rules to respect
Before going out to the streets to protest it is good to take a look at the rules imposed by the DPCM for public demonstrations. In fact, even a peaceful demonstration motivated by the noblest intentions can turn into an outbreak if the precautions of the competent authorities are not respected. In particular, the First Ministerial Decree of May 18 (Article 1, paragraph 1, letter i) regarding the right of demonstration, establishes the following:
“The holding of public events is allowed only statically, provided that during them the prescribed social distances and other containment measures are observed, in compliance with the provisions of the questore in accordance with article 18 of the Single Text of the laws of public security referred to in the Royal Decree of June 18, 1931, n.773 “.
In short, this means that demonstrating in city squares or other public places is only possible:
- statically, therefore, when stationary (Itinerant processions are prohibited);
- keeping the interpersonal distance of at least one meter among the participants;
- with the protective mask covering the nose and mouth.
What risk those who demonstrate without respecting the rules
The demonstration is in itself an opportunity to meet and those who do not comply with the rules established by the Government risk heavy sanctions: fine from 400 to 1,000 euros (established by decree Beware Italy) which can be increased at the discretion of the police in case of relapse. Those who, on the other hand, go down to demonstrate in the streets violating quarantine or isolation risk even the penalty with the application of article 452 of the Penal Code. “Negligent crimes against public health”, The same for those who leave home to manifest despite body temperature equal to or greater than 37.5 °.
The fine can be paid at a reduced rate In 5 days from the notification with the discount of 30% (i.e. 280 euros).
Other risks and penalties
The penalties provided for the violation of the anti-Covid rules can be added to the others if the event results in violence against things and people. In this case the offenders could incur in the complaint for “Vandalism”, “Personal injury”, “Indignation or violence against a public official”, with serious consequences both at the civil and criminal level.
