Curfew fines: what (and how much) those who leave without reason risk

Campania and Lombardy have imposed the curfew from 11 pm to 5 am, while in Lazio the restrictive measure begins in 24.00, but the penalties are the same: fine from 400 to 1,000 euros, as established in the decree Beware Italy (Article 4 of Decree-Law No. 19/2020). This is the same sanction provided for those who do not wear the mask outdoors or on public transport and do not respect the ban on gathering.

The fine, at the discretion of law enforcement agencies, may be increased by one third if the curfew violation occurs in aboard a vehicle.

Like any administrative penalty, even that of those who leave during the curfew can be challenged with an appeal within 30 days of notification and, alternatively, paid in installments. Those who proceed within 5 days have the right to 30% off on the total amount (paying 280 euros to a minimum).

What businesses open during the risk of curfew

The curfew also applies to commercial establishments (clubs, bars, restaurants) that are at risk of even more severe penalties. In addition to the fine of 400 to 1,000 euros, the accessory penalty of the closure of the activity up to 5 days to avoid the continuation or repetition of the violation.

Self-certification: the reasons for leaving and what you risk declaring false

Going out during curfew is not absolutely prohibited. Still possible for proven needs of work, health, need and urgency, that is, all those situations that require immediate action (here is the complete list of when you can leave at curfew).

But be careful not to write voluntarily incorrect reasons or personal data because it could trigger the complaint for false (Article 495 of the Penal Code) with the prison from 1 to 6 years.
