Among the rights of permanent and non-permanent school personnel is that of being able to benefit from permits to participate in competitions and exams, although it should be noted that there are differences depending on the type of contract. The reference legislation is the CCLN 2007, confirmed by the new Contract 2016/18.
Teachers with permanent contracts
Article 15.1 of the CCLN reads as follows:
The school employee with an indefinite employment contract is entitled, on the basis of adequate documentation, including self-certification, to paid leave for the following cases:
participation in competitions or exams: 8 days in total per school year, including those needed for travel.
How to use
Permanent teachers will be able to take advantage of the 8 days off throughout the school year only for the days in which the contest / exam tests will take place and to get to the place (including the return) where the contest will be held / exam.
These same days cannot be used to prepare exams, in fact specifically, the legislation establishes that the teacher can request other permits such as study permit and license for study reasons.
They can also be used if the exam or competition test takes place outside of business hours. In fact, the requested leave cannot be related to the work schedule itself, even if the competition test or the exam was held in the afternoon.
Part-time staff can also benefit from these leaves, in proportion to the expected weekly working days (the administration identifies the days off for each part-time employee, in relation to the working hours of each one of them).
To benefit from the permits for the contest / exam, teachers must submit to the Director documentation that justifies the request and participation in the exam or contest, indicating the days on which the tests in question will be held.
For what types of exams or contests can I request permits?
There is no limitation since article 15 of the CCLN with reference to the possibility of taking advantage of paid leave does not impose restrictions on the type of contests or exams that can justify the use of the eight days of leave.
What does the paid leave request mean for the teacher?
The teacher will not be sanctioned in any way, neither from the legal nor the economic point of view since the days off will be paid in full, evaluated for seniority purposes and will not reduce vacations.
Temporary staff
Although the only difference that exists between permanent teachers and temporary workers is the legal and economic situation, we are still far from ensuring that both categories can enjoy the same rights, in fact temporary teachers can take advantage of the permits to participate in competitions or exams but with substantial differences.
The reference legislation is art. 19 paragraph 7 of the CCLN which reads the following:
Unpaid leave is granted to fixed-term teaching, educational, and ATA staff, including those mentioned in paragraph 5 above, to participate in contests or examinations, within a total of eight days per school year, including any required for trip …
From this it follows that the permanent contract staff will be able to take advantage of the eight days during the school year but the latter will not charge and will interrupt the duration of the service, thus affecting those days of service that could be used by teachers in the procedures. how to update the GPS or GAE.
For all the other conditions expressed above in relation to full professors, temporary professors will also benefit from them, except for non-recognition of the eight-day salary for leave for exams or competitions.
