The Palamara case: all stages of the chaos chaos
Palamara’s apologies
“I have not sold my role to Lotti, or Centofanti, or to others.” “The accusation of corruption has dropped for having pocketed 40 thousand euros.” “On a personal level I was wrong, but I did not understand that my private life was also public.” “I do not intend to escape either the trials or the confrontation, but I ask to be tried in peace and to read the papers before being tried.” After the expulsion in July of the judges’ union of which he was president, Luca Palamara appears before the assembly of the Anm. White shirt, very Roman accent, an improvised intervention in a very dense silence. He defines himself as a “clerk” for his activity as a prosecutor and this later costs him a series of outrageous reactions from his colleagues. He speaks directly with two of them, Mario Palazzi and Eugenio Albamonte, present in the Angelicum auditorium, who were prosecutors in Rome with him, and says “in some sentences that I said about you in particular moments of my life, I recognize myself”.
But Palazzi’s own relationship is very hard: “Where is Luca Palamara, who entered with the procession of cameras and left with the same procession? I do not accept his apologies, if he said that I have a bad temper, that I am unpleasant, that professionally I do not I am worth nothing, I would have accepted his judgment, even if it is worth nothing. On the other hand, Palamara, with two parliamentarians of the Republic, one of whom I have requested indictment, thinks of a new structure of the Rome prosecutor in which someone like Mario Palazzi had to kneel, the new prosecutor had to make him kneel. Palamara admitted the historical fact. Do we still want the whole country to make fun of what they have read in outrage? “And then he went directly to Palamara:” You would have done well to have more elegance towards an Anm who has given you too much, you no longer have to continue in this deleterious operation of mockery of a category that does not knock on the doors of the powerful, but works from morning to tomorrow night. Palamara cannot be in the same more association than me. ”
A dramatic showdown
Inevitably, the confrontation between Palamara and his ANM colleagues – actually few in the great Angelicum Auditorium – takes on dramatic tones. The former Rome prosecutor had asked to be heard publicly in July. Today the companions listened to him for about twenty minutes. In which Palamara reviewed the accusations made against him by the prosecutor of Perugia and the attorney general of the Cassation. He immediately clarifies: “It is not my intention to escape, before me comes the interest of the Judicial Power and colleagues who, to my regret, have been overwhelmed.” Again: “My intention was not to escape, hide, leave, but only to explain what happened.”
Palamara: “This CSM is not impartial, see”. But the disciplinary section says no
He asks his colleagues to wait for the result of the CSM’s disciplinary sentence before finally deciding on his expulsion from the ANM, because, from his point of view, “that interception of the Champagne hotel, in that way, could not be done, given that there is an indication from the Perugia prosecutor asking to turn off the microphone in the presence of parliamentarians. Matter on which the CSM must rule. A postponement, however, that the assembly of the ANM decides not to grant and therefore go directly to the confirmation of the expulsion.
Palamara’s self-defense
Palamara says: “In the talks I answer the facts that concern me, I don’t want to involve anyone, I don’t have the attitude of saying that Samson dies with all the Philistines.” Then he quotes the former CSM toga Piergiorgio Morosini from Area who in an interview said “what do you want me to tell you, politics comes in everywhere here, I can’t wait to go back to the trenches”. It is your line of defense from the beginning. So much so that he repeats: “The comrades who were not part of the currents were left out of the agreements.” He states that his relationship with the deputy Pd Luca Lotti “was pre-existing and intensified with the election of Vice President Ermini (in 2018)”. Then a long confession: “I made a mistake returning to the Rome prosecutor’s office, especially after the publication of an article anticipating the Perugia investigation in September 2018. It was a mistake to run for the Rome deputy prosecutor. For the thousand After all, the incredible requests came from all over the judiciary. Anyone who knows me knows that I am disorderly and at night I did not cancel the talks, although they hurt me because my disciplinary procedures have increased since they left. ”
Then he goes back to the hottest phases that led him to be investigated. “Since 2019 I have intensified my relationship with Stefano Fava, to whom I have been linked since I entered the judiciary, he has made me the custodian of one of his work histories, I was disappointed by the news that came from Perugia.” He states that those with Lotti (“who had already been processed”) and Cosimo Maria Ferri (former PD deputy now Renziano) at the Champagne hotel “were not clandestine meetings, that hotel is not a place to hide, it is the hotel where he lived a councilor, there is no P2 “. It says that “the secretaries of the streams are present during the meetings of the CSM.” He still says: “I was overwhelmed and in the flood I got lost, I spoke to everyone, but I was not morally unworthy of anyone, I represented Unicost, it was not Palamara who invented that for four posts in the afternoon at the CSM there were only four candidates.” And he closes: “In my private life I wrote private messages, I was wrong because I did not understand that my private life was public.”
Poniz: “Does Anm not think about racing? Okay”
Palamara makes three strategic mistakes in his self-defense. She enters the auditorium followed by the cameras (although it does not depend on her will and she cannot avoid it), but that irritates her companions. During his self-defense, he minimizes his work in Reggio Calabria and defines himself as a “pirate”. Word that is then repeated in all the interventions, obviously to deny that a magistrate is a hack and therefore distance himself from him. Finally, after speaking, he always goes with the cameras and does not listen to the debate.
That the president of the ANM, the Milanese prosecutor Luca Poniz, closes hard in the following way: “His escape with a camera tracking prevented us from asking him questions. What did he mean when he said that the Anm does not count a ca … After having been president? If the Anm is the one that does not think about careers, but about the protection of rights, then I am glad that it does not have a ca … “In any case, it reiterates that the judges union, In the whole matter, “he had no worries or fears.” He says that, when the case broke out in May 2029, “he immediately went to the Perugia prosecutor’s office, the Guardian of the Bonafede Stamps, the then Pg Fuzio, the vice president of the CSM Ermini, to request the documents immediately. We have not resigned ourselves to this battle. When the case exploded again, on May 3 of this year, I reiterated the requests, and I myself went to Perugia ”. Now the letters have arrived, all the chats. It will be up to the referees to take care of it. But this advice is only one month in advance because between October 18 and 20 the approximately 10,000 Italian robes will go to electronic voting to elect the new Anm.
There is no voice in favor of the former prosecutor. And this sounds like a preview of the vote confirming his expulsion from the judges union. This is what the Genoese Marcello Basilico says: “I want an association independent of Ferri and Lotti, and I don’t want to be in the same Anm with Palamara.” My colleague Fanteschi from Florence: “I was ashamed not to be a judge, but to be in the ANM.” Maria Rosaria Savaglio: “The delegitimization of the ANM is a vulnus. Instead of him, the entire judiciary is becoming Palamara’s scapegoat, there are many judges who have never thought of going to a politician for a judicial appointment. chapter and let’s talk about the judicial system. “Paola Cervo:” I heard myself say, but who makes you go to Anm? Are you as bad as them? “. Lilli Arbore:” I am not a slave to the currents. Let’s vote. And let Anm be everyone’s home. “Tiziana Orrù, like many others, says:” I do not write letters. “Carlo Sabatini:” I am proud that the ANM has given an immediate response, which others have not. “Paola Cameran: “I submitted my questions to the CSM and they were rejected. We thank all those who were not beggars because there was a sea of beggars. Let’s close this page and open a blank one. “Cristina Ornano:” I am sorry for Palamara on a human level, but his conduct has soiled the faces of all the judges. “The secretary of the ANM Giuliano Caputo closes:” Today we are called to evaluate concrete facts, but clearly we have not resolved anything with the expulsion of Palamara. The Anm is a heritage to be conserved precisely because it still has the capacity to represent – transparently, linearly and with the consequent responsibilities – the requests and needs of all magistrates ”.
