Mario Rosario Morelli the new president of the Constitutional Court, until this morning vice president. He was the oldest candidate to remain on the Council, and will remain in office until next December, when his mandate as constitutional judge expires.
Therefore, the Court followed the wording of following the seniority criterion, but non all’unanimit, as had happened last December when she was elected Marta Cartabia placeholder image.
Morelli got it 8 votes, while 5 went to the judge Giancarlo courage (his term will end in January 2022) and a Giuliano Amato which would have guaranteed two years of presidency, until September 2022. Coraggio and Amato have been appointed vice-presidents of the Council.
With this short presidency (but in the past there have been even shorter ones) the judges have privileged, together with the criterion of seniority, the path of collegiality in the management of the Court over the alternative of functionality (which in any case would not have it certainly affected the image of the collegiate body); they pointed out a president who, precisely because of the method by which he was elected, represents the institution as a whole, without giving too much weight to the fact that another will have to be elected in three months.
A decision preceded by an internal debate that had grown more intense in recent days and ended up dividing the judges, as evidenced by the result of the vote.
