A crazy race from Caivano to Acerra, with the two scooters coming side by side to appear, on cameras, a single vehicle. In the first, a Sh 300, there were Ciro Migliore and girlfriend, Maria Paola Gaglione, on the other, a Honda Adv motorcycle, was his brother, Michele Antonio Gaglione, all residents in the Parque Verde Caivano. A chase in which the boy tried several times to stop the scooter, until the curve of via degli Etruschi, where the Sh is ruined on the side of the road. María Paola died instantly, Ciro broke his arm. For the judges, it does not matter if the skateboard fell due to the last kick or in an escape attempt, what caused that accident was the pursuit and the boy’s continuous attempts to stop, with violence, the two fleeing boyfriends. It is the reconstruction contained in the order that validates the arrest of Michele Gaglione, currently arrested on involuntary manslaughter charges.
The accident in which Maria Paola Gaglione died
The tragedy has passed the night of September 11 last, in via degli Etruschi, the so-called Palmentella, in Acerra, in the province of Naples. When the Carabinieri from Acerra arrived, at number 151 there were two scooters. One, the Honda Adv, was standing on the right hand side stand. On the left side, among the undergrowth of a field, Sh. And, a few meters away, the lifeless body of Maria Paola Gaglione: when she fell, she collided with an irrigation pipe, the impact was fatal.
Michele Gaglione himself told what happened, as it is reconstructed in the ordinance. She told the carabinieri that the dead girl was her sister, that she was on a scooter with another girl, and that she had chased them for demonstrate opposition to your relationship; During the race, she added, the young driver had lost control and ended up on the field. “The other girl” was Ciro Migliore. Transsexual, in transition from female to male (for this reason the female name is still indicated in the ordinance, which is the personal name). And that’s exactly why the boy was against that relationship, that had been going on for almost three years.
A call for help from a neighboring house
While the carabinieri were listening to Michele Gaglione, Ciro Migliore had gone to ask for help. A man tells it that that night he was at a friend’s house in Acerra. At around 1:30 am, he explains, a boy persistently called the intercom, saying he was involved in a car accident and injured his arm. The man saw in the distance the flashing lights of the ambulances and the police, got out, tried to help “this guy” by making him lie on the ground and called 112.
Ciro also told him having escaped from Caivano on a scooter and having been attacked several times by his girlfriend’s brother, who had chased them and tried to stop them by kicking the Sh and cutting the road, until the curve where, after another kick, the accident was. He also recounted what happened immediately afterwards: while María Paola was immobile on the ground, Michele pounced on him and hit him. Only later, realizing that her sister showed no signs of life, did she call her parents and 112.
Threats to break the relationship.
Later, Ciro confirmed the statements to the carabinieri. Heard at the Villa dei Fiori clinic, where he was admitted for the injury to his arm, he recounted that relationship that had been taking place for almost three years, with strong opposition from Maria Paola’s family, with whom the girl had no contact during one month. , and that last July there were also threats. On July 13, he reported, Michele Gaglione went to his home and said: “If you don’t leave my sister alone I’ll cut off your head and kill you“.
There are more investigations into the threats: it seems that some of the girl’s relatives were close to organized crime circles and now investigators want to know if Ciro had received other “warnings” in recent months.
On the night of the accident, Ciro continued, Michele was probably waiting for you in via Fratelli Rosselli, in Caivano, the road he knew they would take to go to Acerra, where the couple was staying with a relative of the child. Throughout the chase, Maria Paola had been trying to calm her brother down, telling him to stop chasing them and kicking the Sh because doing so would put them both in danger.
“I remember getting one last violent kick to the left side of the scooter. – said Ciro – and unfortunately this action coincided with the course of a curve to the right in which, due to the blow suffered, I lost control of the bike, ending up on the left side of the road and crashing to the ground next to María Paola. I managed to get up but was joined by Michele, who threw two blows at me on the fly and a kick and then headed towards his sister who was sprawled out on the grass. Fearing for my safety, I ran and called the first house I found. “
Brother of María Paola accused of intentional homicide
The researchers found marks on the shell of Ciro Gaglione’s Sh that are compatible with the kicks and the shoes worn by Michele Gaglione, confirming this part of the story. However, it is not clear whether one of these hits caused the accident. According to Ciro, definitely yes: he said he lost control after another football. On the contrary, Michele Gaglione, although he admitted to hitting the scooter several times, reported that he did not cause the accident because, when the scooter fell, it was further back.
A difference that Nola’s investigating judge, in the validation order, considered irrelevant: “it matters little whether Gaglione has struck the “fatal” blow or not with his foot on the skateboard – read the ordinance – because there is no doubt, as admitted by the suspect, that he had a dangerous driving behavior, chasing them with a more powerful motorcycle, managing on several occasions to join them to cut them off and hit the scooter ”. Therefore, “there is no doubt that such behavior was dangerous and appropriate for Migliore’s loss of control of the scooter, especially due to the fact that it was repeated several times during the race.”
In addition to the homicide with the aggravation of futile causes, Judge Fortuna Basile also confirmed Michele Antonio Gaglione the accusation of injury against CiroSince, as the boy related and confirmed by the accused, immediately after the accident he beat him with his fists and kicks. For Michele Gaglione custody in prison was decided. The lawyers Domenico Paolella and Giovanni Cantelli, his lawyers, have announced that they will appeal to the Court of Review.
