On August 4, 2019, the situation degenerated in Setai Square, where a fight broke out between Scapin and the Carissimi and Ferrari company. The 34-year-old man and his girlfriend got in the car to go home. The “rivals” followed. At one point, at the intersection with the Cremasca, someone with a beer bottle broke the rear window of Scapin’s Mini. The prosecutor’s conviction is that the latter reacted on impulse, voluntarily trying to run over the two boys. His intention was probably to take them down without killing them. But, according to the prosecution, possible fraud is contemplated: at that speed (the Mini was moving between 81 and 86 km / h, the scooter at 71 km / h) it had to be taken into account that the fall could have been fatal. . The defense argues instead that it was an incorrect and involuntary maneuver, due to the fear of the explosion of the rear window and the emotion of those moments. That night his BAC (measured almost two hours after the fact) was 1.49 grams of alcohol per liter of blood, almost three times the limit.
