Workers’ union moves to demand the Ciptaker law in the Constitutional Court

Confederation Union Alliance Work Indonesia (KASBI) plans to present judicial review (JR) or test materials for Constitutional court after the Legal Plan (RUU) Cipta Kerja Omnibus Law approved by the DPR in plenary session, on Monday (5/10).

KASBI Secretary General (Sekjen) Sunarno revealed that this option did not rule out the possibility of being taken if the government closely monitored and heard rejecting workers’ demands that the Ciptaker Act be repealed.

“In addition, what we are also preparing is a lawsuit, so we will present it later in the judicial review in the Constitutional Court,” Sunarno said by telephone to CNNIndonesia.com, Tuesday (6/10).


Apart from that, Sunarno said that his party would still maximize the national labor strike in various areas that will take place for three days from today until Thursday (8/10).

Later, he said, the peak action on the last day would take place in front of the Presidential Palace, Jakarta, along with a number of other elements of society, such as student organizations and the general public movement. The action will require President Joko Widodo to issue a Government Regulation in lieu of a law (Perppu) on repealing the Ciptaker Act.

Sunarno said that the location of the action had moved in front of the DPR / MPR complex after the plenary meeting that was taking place. He estimates that the action will be followed by at least 20 thousand masses of joint action.

“So yesterday the plan was for our National Consolidation to even take action at the State Palace. Demanding revocation, and there is a Perppu. But then we will do it again, “he said.

The judicial review effort before the Constitutional Court is also an option currently being finalized by the labor elements of the Confederation of Indonesian Workers’ Unions (KPBI).

“We continue the match, JR as an effort for the match that we will do,” said Jumisih, deputy head of KPBI.

In addition to taking a judicial review, Jumisih said, workers will also continue to fight in other ways, that is, mobilizing all elements of the work in Indonesia to take to the streets.

“The other (form of resistance) is, of course, how the trade union movement and all Indonesians are resisting the legal system in Indonesia, which is not in our favor,” Jumisih said.

Jumisih’s statement was also confirmed by Roy Jinto, president of the Federation of Textile, Clothing and Leather Workers’ Union, Roy Jinto.

He said that the constitutional step that the Workers’ Union would take against the Government and the DPR with respect to this law would be to carry out a judicial review in the Constitutional Court.

“JR will definitely do it. Both formally and materially from the Job Creation Act,” he said.

Roy said the union would group forum Advance Discussion (FGD) likely to take place after October 8. This FGD is made to formulate the articles of the law that will be reported to the MK.

“But in general, in terms of formality, the process will be questioned in substance and then also in the discussion, there are some academic texts that do not conform to this content, we will JR,” he said.

“Because it was the only way after the law was passed, when Perppu didn’t come out, only JR canceled it,” he said.
