Jakarta, CNN Indonesia –

Work in response to an open letter sent by the Minister of Labor Ida Fauziah question Job creation law to them. Through the Confederation of Indonesian Workers’ Unions (KSPI) they said that all statements made by the Minister of Manpower in the letter were just rhetoric and did not contain any useful content for workers.

“Miss Ida’s open letter speech, stop the rhetoric, don’t build any more lies,” said KSPI President Said Iqbal. CNNIndonesia.com on Tuesday (6/10).

One of the rhetorics of Iqbal’s words can be read in the public statement of the Minister of Manpower that affirms that the government has acted fairly and maintains a balance of interests between employers and workers when the Omnibus Bill is discussed. Cipta Kerja (Ciptaker).

He said there was no justice and balance provided by the government. He argued, if what the government really wants when discussing the Job Creation Bill is to create a balance, then why are fundamental workers’ rights being sacrificed?

The policy, said Iqbal, can be seen from the elimination of the determination of the city / regency minimum wage (UMK) and the city / district sector minimum wage (UMSK). He said that this elimination would actually create an imbalance.

The reason is that abolition makes the wage system unclear. When that happens, workers are in a weak position.

“UMSK is removed, does the car factory taste the same as the cookie factory? In fact, it is not balanced, so the minimum wage of the Directorate / City is made, ”he said.

Another provision that has the potential to put pressure on workers is a fixed-time work agreement (PKWT) that states that there is no contract time limit. Although not clearly explained, this point allows employers not to hire workers and extend the employment contract for life.

“People can be hired for life, what is the balance? This rhetoric is built to deviate,” he added.

Admitting that he was not satisfied with the handling of the fate of the workers by the Ministry of Manpower, he said that he was reluctant to return to the discussion as stated in the open letter.

KSPI, he said, would pave another path, namely, to ask for a dialogue with President Joko Widodo (Jokowi) before the president passes the bill in the next 30 days.

“We will ask, we will beg President Jokowi for 30 days before being enacted, we will request a process of dialogue with the president and we will try to meet with the president,” he continued.

Similarly, Indonesian Aspect President Mirah Sumirat viewed Menaker’s invitation to negotiate again as just a promise (lip service). The reason is that the negotiations have been carried out by President Jokowi’s task force that culminated in the resignation of some of the unions.

He viewed the negotiations only as legitimacy, a symbol that the government had accommodated the negotiations to fight for labor rights. However, the aspirations that have been transmitted are not taken to become the official referent of the bill.

Therefore, you do not see the need for a renegotiation if the job application is not a reference for the outcome of the negotiations.

“In the discussion of the work team, we asked if the aspirations would become an official reference for the RI of the RPD, the answer was ‘oh no, only complacent suggestions, there is no certainty of official referrals’, we were fired up”, he explained .

Once again, he emphasized that the Minister’s request for negotiation was only lip service because his party did not accept an invitation to discuss it. Mirah assessed that if Menaker intended to negotiate, an official invitation letter should have been sent to the union.

“If you say that you want to be invited to a negotiation, is there an invitation? Is there no space for discussion or negotiation? Is it not there, that is, just talk? Officially, the organization has a clear direction, we are not guests, “he said.

However, he did not rule out the possibility of returning to discussions with the government on the condition that this time the government really listens to the aspirations of the workers and makes them part of the uu.

“It depends, we are parallel, the law allows (demonstrations), although the situation is too late to vote on October 6 and 8 (strike), but in the middle there is an invitation, why not?” the lid.

Previously, Labor Minister Ida Fauziah wrote an open letter to unions and workers who still rejected the ratification of the Ciptaker Plan of the Omnibus Law.

In the letter, he said the government was trying to find a balance between protecting those already working and providing job opportunities to millions of people who were still unemployed, who he said had no income and were proud.

In addition, Ida explained that since the beginning of 2020 the government has also tried to dialogue about the Draft Law on Job Creation, both formally through tripartite institutions, and informally.
