Last night the Polda Metro Jaya carried out a reconstruction of the incident or a reconstruction of the shooting of six members of the Islamic Defenders Front army. The police also mentioned a new fact, namely that two of the six Laskar were shot during the pursuit process. And four others were captured alive and put in a police car to be dragged to the police station. The other four members of the laskar, but who died in the end, were said to have been due to resistance efforts.
The general secretary of the FPI, Munarman, considers that the police statement about the shooting of six members of the FPI paramilitaries last week changed after the results of the media investigation were known. Munarman was disappointed in the attitude of the police.
Munarman emphasized that there was structural violence against the death of the six members of the FPI laskar. He was also surprised that the police statement had changed.
“The strangeness that is even more serious is the structural violence that must stop. Why was there shooting at the beginning and then the attack? Then it changed after being investigated by journalists, there was no shooting at the scene,” Munarman said after visiting Habib Rizieq Shihab at Polda Metro Jaya on Monday (12/14).
Munarman discovered that there was a shooting that caused the death of two members of the laskar. Then the remaining four died because they were involved in a fight when the policemen were taken to Polda Metro Jaya after being arrested. Munarman considered this information to be different because previously all six were thought to have died simultaneously in the shooting.
“Then the attack (on) the car, if the attack on the car we questioned him. If the four people were still alive, it means they were stabbed, it was admitted that the four people (initially) were still alive. That’s the point,” he said. Munarman.
“The four were still alive at that time, there were no shots, then they were taken away by car and in the car they were slandered for trying to arrest (weapons) the officers,” Munarman continued. Apart from that, Munarman claimed that there were journalists who were questioned by the police in the case of the shooting. According to him, this added to the rarity of the shooting of the six FPI soldiers.
“It has been proven that the structural violence was carried out by summoning journalists to Bareskrim and being called as a witness. Although he only reported that he was cited in case (article) 170, it is strange, ”Munarman said.
The journalist in question is Edy Mulyadi. Bareskrim Polri interrogated him because he uploaded a news video related to the clash between FPI and Polri on the Jakarta-Cikampek toll road. He was examined today Monday (12/14). Edy Mulyadi was quoted in a letter numbered S.Pgl / 2792 / XII / 2020 / Dit Tipidum dated December 11, 2020.
Munarman arrived at Polda Metro Jaya today to visit the detained Habib Rizieq. Munarman said Habib Rizieq was in good condition.
“He was still happy, he smiled jokingly and conveyed the message that he must not stop fighting, and must not forget that the case of the massacre of the six martyrs must continue to be exposed to its roots,” Munarman said.
He left a message to Munarman that the six FPI paramilitaries who died would not accept the spiral of violence. The violent spiral is violence that is repeated and continues after the victim dies. Habib Rizieq is concerned that his bodyguard’s six troops will be slandered.
“What is verbal violence? They are accused of being slandered as weapons, attacking slandered as perpetrators. That is verbal violence and then the worst thing is that they are victims of structural violence. structural violence, “Munarman said.
Munarman acknowledged that he was concerned that the case for the deaths of the six FPI soldiers was actually floating around. “Where the case is fabricated in such a way, as if once again they were the perpetrators and not the victims. This has been proven as structural violence,” Munarman said.
The National Human Rights Commission (Komnas HAM) continues to try to clarify the facts behind the murder of six members of the FPI paramilitary army. So far, the agency has been unable to conclude that the incident was a human rights violation.
Komnas HAM Commissioner Mohamad Choirul Anam said it still takes time for his team to draw conclusions to define the case. However, he said, the outreach team he led had almost perfectly prepared the construction of the incident that took place at Km 50 of the Japek toll road on Monday (7/12) that morning.
“We already have construction events in the 80 percent range,” Anam said when meeting at the Komnas HAM office, Jakarta, on Monday (12/14). He said fact-building based on the results of the disclosure and the investigation would still take place until Komnas HAM is concluded.
“Further on we still need experts who are completely clear (independent) about this, to conclude whether this is a human rights violation or not,” Anam explained.
Anam said that since the investigation team was formed on Monday (7/12), more than 20 people have been questioned. The Komnas HAM team, Anam said, had also visited FPI headquarters to request initial information. In fact, Anam said, his team also requested testimony from the victims’ families, and from several members of the FPI who learned about the incident in the field and were declared fugitives by the Polda Metro Jaya.
“We (Komnas HAM) are already working, before anyone started it,” Anam said.
In fact, Anam admitted that he and his team visited the crime scene (TKP) more than three times along Km 50, and several kilometers after. “Five points where the incident was with the team. Including the house that was used as the scene of the incident, ”he said.
Anam said, there is a number of evidences of what happened. Anam displays a series of documentation containing observations of the team at the TKP. The documentation consists of images and videos of the research team using a macro metal detector to search for projectiles from the launched bullets.
“We get what can be sustained and what can be seen,” explained Anam.
However, he still did not have the courage to reveal the evidence, sufficient to define the incident at the Japek Km-50 toll road as an incident of human rights violations. “Therefore, we cannot conclude. Due to consultations from various parties, we are still doing so. The team will conclude once construction of this incident is complete,” Anam explained.
On Monday (12/14), Komnas HAM obtained additional evidence from two sources who were asked to provide information. Namely, Jasa Marga General Director (Dirut) Subakti Syukur and Metro Jaya Police Chief Inspector General Fadil Imran.
Anam continued, from the state company that manages the highway, Komnas HAM obtained additional evidence in the form of CCTV images of the monitoring of tolls from Km 48 to Km 72. “Jasa Marga provided a hard drive before. But I have not yet seen the content, ”Anam said.
Komnas HAM also responded to the demand for an investigation team (TPF). Komnas HAM Commissioner Beka Ulung Hapsara said that Komnas HAM had indeed formed an investigation team in the case of the deaths of six FPI soldiers shortly after the shooting was discovered. “The term investigation team is the Monitoring and Investigation Team,” he said.
There are several commissioners from Komnas HAM in the team. Apart from the assistance of various related experts, to analyze the findings and the existing evidence.
Meanwhile, the Chief of the Metro Jaya Regional Police, Inspector General Fadil, conveyed the police’s commitment to support the investigation and disclosure of facts that Komnas HAM is currently carrying out. Fadil was unwilling to reveal what information he gave to Komnas HAM. However, it was assured, the police would be willing to help and provide evidence to the Komnas HAM investigation team to produce a responsible report.
“We (the police) have an interest in making this case bright in the eyes of the public. We provide facts based on scientific crime investigations. And we do not want to build a narrative. Therefore, we support Komnas HAM,” he said. Fadil The two-star general also emphasized that he will always attend Komnas HAM if additional information is requested.
“I obey the law. They called me (Komnas HAM), I came. And I came myself,” he said.
Meanwhile, a criminal law observer from the University of Indonesia (UI) Eva Achjani Zulfa believes that it is necessary to first identify the incident of the death of the FPI troops. “If what happens is a criminal act of serious human rights violations referred to in Law 26/2000, then it is appropriate to present it to Komnas HAM. However, if what happens is a common crime as regulated in the Criminal Code, so the Criminal Procedure Code refers to the Police, “Eva said.
Eva explained that, on the one hand, the shooting cases were a form of human rights violation that was also a violation of the law. Therefore, in reference to article 1 number 6 of Law 39/1999 on Human Rights, the best mechanism for its management and resolution is through the criminal justice system.
“Unfortunately, in this case, it is suspected that the perpetrators come from related institutions. Therefore, another institution that is independent and that the public can trust is needed to assist the work of the National Police in handling this problem. “, said.
He called on the government to continue forming the TPF to investigate the case. According to him, this is necessary to maintain neutrality and to ensure that the police work in a neutral manner.
Earlier, President Jokowi spoke about the murder of six FPI soldiers. Jokowi said law enforcement officers, in this case the police, are required to enforce the law firmly and fairly.
Even in the performance of their duties, the president said officers are protected by applicable laws and regulations. “Remember, law enforcement officers are protected by law in the performance of their duties,” Jokowi said in a press release at the Bogor Presidential Palace on Sunday afternoon (12/13).
The president also provides solutions for community groups that have differences of opinion regarding the legal process against someone. If there are differences in legal opinions, Jokowi will invite the public to take the existing legal mechanisms.
“If necessary, if we need the participation of an independent institution, we have Komnas HAM. Where people can present their complaints. Once again I emphasize that we must maintain justice and legal security in our country. Maintain the foundations for the progress of Indonesia, “he said.
