LGBT is one of the acts that a soldier should not perform.
REPUBLIKA.CO.ID, JAKARTA – TNIs will implement strict sanctions against TNI soldiers who are shown to have violated the law of decency, including lesbian, gay, bisexual and transgender (LGBT) people. Regarding the existence of a military court that acquitted individual soldiers who are LGBT perpetrators, TNI is still making further clarifications.
“Regarding the statement made by the Chief of the Military Chamber of the Supreme Court on YouTube during the briefing of the military judges on the existence of a military court that freed LGBT soldiers, it is still being clarified to obtain valid data” TNI Puspen chief Colonel Sus Aidil said when confirmed. , Thursday (10/15).
According to Aidil, the TNI commander has issued a telgram letter number ST No. ST / 398/2009 of July 22, 2009 and emphasized again by the telegram No. ST / 1648/2019 of October 22, 2019 that emphasized that LGBT it is one of the actions that a soldier should not perform. “It goes against military discipline and is a serious violation that should not occur within TNI. The legal process is strictly enforced when receiving an additional penalty of removal by trial in a military court,” he said.
In addition, Law No. 34 of 2004 relating to TNIs also regulates that soldiers can be dishonorably discharged from military service because they have traits or actions that can clearly harm TNI military discipline. “It’s in Article 62 of the TNI Law,” he said.
The president of the Military Chamber of the Supreme Court (MA), Major General (Purn) Burhan Dahlan, said that there are lesbian, gay, bisexual and transgender (LGBT) groups within TNI. The group is led by a sergeant and its members are lieutenant colonels (lieutenants).
“Apparently, they told me, there are already new groups, the TNI-Polri LGBT union group. The leader is the sergeant, the members are the lieutenant colonel. This is unique, but it is a reality,” Burhan said in the Orientation activity Technique and Judicial Administration of Environmental IV. The entire Indonesian Judiciary broadcast on YouTube channel MA, quoted on Thursday (10/15).
Burhan said this case was different from the LGBT case he handled in 2008. Burhan said that in 2008 he tried the first LGBT case within TNI. At that time, in his decision Burhan did not punish the person in question, but instead ordered the commander to treat him until he was cured.
“Why? When the expert said that at the time it was a mid-ranking officer who had just returned from the East Timor operations. As soon as he became depressed in performing the duties of the operation, he formed thoughts, Feelings, mentally, were distorted, “he said.
In this case, he said, the situation was different. The previous case was the result of pressure from military operations. Currently the reason is more the social phenomenon. They get a lot of information through short message app groups, watching videos, etc. which Burhan says causes their behavior to drift.
