Instruction of the Minister of the Interior Titus Karnavian on the removal of regional chiefs who violate the health protocol COVID-19 considered reckless and excessive.
Parahyangan University Professor of Constitutional Law Asep Warlan Yusuf explained that the government should not impose sanctions on regional chiefs who violate health protocols.

It is known that Tito issued Instruction number 6 of 2020 on the application of health protocols to control the spread of the Covid-19 virus, after a crowd that appeared at the FPI Grand Imam Rizieq Shihab. The instructions include the threat of sanctions to remove regional chiefs who violate health protocols.
The former head of the National Police is based on Law No. 23 of 2004 of Regional Government that regulates the dismissal of regional chiefs who violate provisions.
However, according to Asep, the issue of the Covid-19 health protocol is not entirely the responsibility of the regional head, but also of the central government and other institutions.
“The management of the covid is not only the head of the region, but the central government, other vertical agencies, the police, the prosecution. In the regions they also form a working group, a working group. So many parties are involved,” he explained .
“For example, because the crowd was immediately withdrawn, this was too reckless,” he continued.
Asep said the government should prioritize a coordination approach rather than taking legal action. In addition, fellow government administrators must communicate with each other.
Asep assessed that the government had misinterpreted the Regional Government Law on the removal of regional chiefs. He did not deny that the regional chiefs could be removed for various reasons, but these were not implemented immediately.
“The government does not understand the law in a comprehensive manner, but only partially. The procedure cannot be suddenly removed, the period is removed due to health protocols,” Asep explained.
Furthermore, the interior minister should have given a verbal or written warning or warning before removing the regional chief who violated it.
“Public officials must be able to protect, right? There is an oral warning, a written warning that must be made. If the dismissal means that the Minister of the Interior does not respect the procedure,” he explained.
For his part, Asep suggested that the Interior Minister review the regulations on the removal of the regional head. He encouraged the Interior Minister to prioritize government communication and respect the position of each public official.
“I believe that the Minister of the Interior has expert staff and it can be discussed first. Make government communication so that they are respected,” he concluded.
Meanwhile, DKI Jakarta Deputy Governor Ahmad Riza Patria declared that he would abide by instructions and any existing regulations, including those issued by the Interior Minister.
Riza said that, as a legal state, the government certainly has rules through laws and other regulations.
“Anyway, we obey the rules and regulations,” he said.
On the other hand, the chairman of Commission A DPRD DKI Jakarta Mujiyono assessed that Tito’s instruction was a warning to all regional chiefs, not just Jakarta.
“I see it as a warning to all regional chiefs, not just Jakarta, which seems to be tolerating, in quotation marks, crowds who do not obey the rules in the procedural and number provisions,” Mujiyono said.
However, he requested that the instruction be further revised by referring to legal regulations.
In Jakarta alone, Mujiyono claims that the provincial government has implemented health protocols. In fact, according to him, the provincial government had advised Rizieq not to create an agenda that would create a crowd.
He himself admitted that it was not easy to handle such a large crowd.
The Provincial Government of DKI is also seen to have been firm in imposing sanctions of IDR 50 million on the crowds who attended the Rizieq event.
“This has been avoided, we have been told. The fines are not an achievement, they are forced. The fines are the last step,” he said.
