The Public Policy Observer, Agus Pambagio, revealed that what became the controversy in the Omnibus Job Creation Bill was a work contract that could be enforced for life.

According to him, the issue of worker status is one of the triggers for the drafting of the Omnibus Law.

Because, he said, until now in Law No. 13 of 2003 on Manpower, companies have the responsibility to grant severance payments to dismissed or dismissed workers.

Agus evaluated that the Omnibus Law Project for Job Creation has positive and negative aspects.

The positive is for the company, it can get investors and hire foreign workers more easily.

“Instead of making a fuss (with the workers), it is better that the company accepts foreign workers. When it is finished one day, go home, replace it again,” he said.

Meanwhile, the negative side is borne by the workers, because they have no guarantees if they lose their jobs.

Decreased protection

Contacted separately, the Secretary General of the Indonesian Workers Organization (OPSI), Timboel Siregar, added that if the Omnibus Law on Job Creation were enacted, it would clearly be very damaging to workers.

He said that worker protection would decrease.

Timboel is concerned that the company will open the contract system as widely as possible Outsourcing. This option, according to him, will cause the loss of certainty for workers.

In addition, Timboel considered, there were a number of things that were onerous for the workers. That is, the rules related to employment agreements for a certain period of time (PWKT), minimum wages, the dismissal process and compensation and benefits for loss of employment (JKP) are subject to Government Regulation (PP ), not laws.

According to him, the issue related to workers’ rights should be the DPR, who are the representatives of the people, to guarantee it, not just leave it in the hands of the government.

“I believe that the norms related to constitutional rights should be regulated in the laws, not in the PP,” said Timboel.
