KONTAN.CO.ID – JAKARTA. The imposition of a new stamp tax rate of Rp 10,000 for electronic documents is postponed from the original plan as of January 1, 2021. It is not yet known for sure when the new stamp tax rate will apply.

Finance Minister (Menkeu) Sri Mulyani Indrawati said that currently the General Directorate (Ditjen) of Taxes of the Ministry of Finance (Kemenkeu) is preparing implementing regulations for Law Number 10 of 2020 on Stamp Tax. Includes technical rules on electronic seal documents.

However, the Finance Minister has not confirmed when the public can obtain the electronic seal.

“There is still no electronic seal, we are currently preparing the infrastructure. First, do the form, distribution and sales infrastructure, which requires preparation. And maybe January 1, 2021 will not take place because preparations will take time, ”Sri Mulyani said at a press conference on Monday (12/21).

Sri Mulyani said that the regulations implementing the Customs Stamp Act will further regulate the fair value limit on documents that are subject to stamp fees.

He stressed that stamp duty is imposed on documents, not on purchase and sale transactions. Responding to the circulating question, Sri Mulyani said that the government should pay attention to the limit of documents subject to stamp duty taking into account the investment climate.

“Since many now react as if they are especially millennials, I am glad that the millennial generation is aware of investing in stocks and shares. That is why we have no desire to diminish the growing interest of investors who will continue to invest in various securities, ”said the minister.

Sri Mulyani emphasized that the purpose of applying the stamp tax is the equivalence of conventional and electronic documents in the imposition of stamp duty.

“Now this stamp tax is a tax on documents or civilization. But not transaction taxes. What appears now is that every stock transaction is subject to stamp tax. Although it is a document tax “, said.

For information, in Law 10/2020, in addition to activating an electronic stamp, the regulation also raises the current stamp tax rates, which are 3,000 and 6,000 IDR. However, because there are still many old tariff stamps circulating in the community, the old stamp can still be used as long as the amount attached is Rp. 10,000 or more.
