Leader of the Islamic Defenders Front (FPI) Rizieq Shihab present at headquarters Polda Metro Jaya to be examined as a suspect in the crowd case in Petamburan, Jakarta on Saturday (12/12).
Rizieq was not the only suspect in the case. Police also named five other people as suspects who were involved in the event, sparking the crowd.
They are Haris Ubaidillah acting as Chairman of the Committee, Ali Bin Alwi Alatas as Secretary of the Committee, Maman Suryadi as Head of Event Security, Sobri Lubis as Head of Event and Idrus as Head of the Events Section.
In this case, Rizieq was charged with article 160 of the Penal Code (KUHP) and article 216 of the Penal Code. Article 160 of the Penal Code itself is known as a criminal act of sedition with a maximum penalty of six years.
This article says: “Whoever in public, orally or in writing, incites to commit a criminal act, to commit acts of violence against a public authority or does not comply with the provisions of the law or a mandate issued based on the provisions of the law, will be punished with a maximum penalty of six years imprisonment or a maximum fine of 4,500 rupees. “
Meanwhile, article 216 of the Penal Code charged Rizieq with a maximum sentence of four months in prison.
It says: “Whoever deliberately does not obey the orders or requests formulated according to the law by an official whose function is to supervise something, or by an official depending on his functions, as well as those who have the power to investigate or examine a criminal act; likewise , who deliberately prevents, To obstruct or frustrate the action to enforce the provisions of the law by one of these officials, will be sanctioned with a maximum prison sentence of four months and two weeks or a maximum fine of Rp. 9,000 ” .
Meanwhile, 5 other suspects were charged using article 93 of Law Number 6 of 2018 on Sanitary Quarantine. This article contains the threat of imprisonment for 1 year.
Article 93 of Law 6/2018 says: “Any person who does not comply with the Sanitary Quarantine administration referred to in article 9 paragraph (1) and / or who obstructs the implementation of the Sanitary Quarantine in a way that causes a Public Health Emergency will be punished with a prison sentence of 1 year and / or a maximum fine of 100 million rupees. “
Seeing this, the FPI legal team voiced their objection. Rizieq’s team of lawyers, Aziz Yanuar, admitted that Rizieq’s objection to being charged with this article. He admitted that he would file a pre-trial case.
“Maybe we will file a pre-trial,” Aziz said in Polda Metro Jaya, Jakarta, on Saturday (12/12).
