JAKARTA, iNews.id – PT Perkebunan Nusantara (PTPN) VIII sent a summons or warning to the leader of the Front of Islamic Defenders (FPI), Habib Rizieq Shihab (HRS) to immediately vacate the land in Megamendung, Bogor, West Java, which is now used as the Islamic boarding school Islamic Markaz (Ponpes). Habib Rizieq’s legal team led by FPI Secretary General Munarman also responded to the subpoena.
In a letter addressed to Mohammad Yudayat as director of PTPN VIII, Habib Rizieq’s team of lawyers said the subpoenas were misdirected. According to them, PTPN VIII should have filed a civil or criminal lawsuit against the party that sold the land to Habib Rizieq.
“This admission was confirmed by the related official who knew and processed the administration of the land transfer. Judging by the aspect of civil law or civil procedure law, PT PN VIII was wrong and had no legal reason to ask to HRS to evict the land unless there was a judicial decision with permanent legal force, “Write the first point in response to the subpoena.
Habib Rizieq’s legal team explained that HRS purchased the land from farmers who had controlled and managed the land for approximately 25 years. Habib Rizieq, on the basis of his long land tenure, believes that peasants control the land.
Habib Rizieq also claims that the process of buying and selling land with farmers is fully known to government officials, from RT, RW, the village to the regent and governor of West Java. Habib Rizieq’s team of lawyers also included the argument of a Supreme Court Circular that confirmed MARI Decision No. 251K / Sip / 1958 of December 26, 1958, which established the legal norms that the buyer was protected by good faith.
