Overtime work adds 1 hour to the Cipta Kerja Omnibus Law

The amendment to the provisions on working time is contained in article 81, points 21 and 22 of the Ciptaker Law, which modifies a series of regulations on working time in Law number 13 of 2003 on labor. Previously, article 78 of the Labor Law established that overtime could only be performed a maximum of 3 hours a day and 14 hours a week.

However, through article 81 point 22 of the Ciptaker Law, overtime is increased by 1 hour. However, the government still requires employers who employ workers or day laborers during working hours to have an agreement with the worker or worker in question.


“Overtime can only be done for a maximum of 4 hours in 1 day and 18 hours in 1 week,” wrote the Ciptaker Act, cited on Tuesday (10/6).

Additionally, the government still requires employers who employ workers or day laborers during work hours to pay overtime wages.

Regarding the provisions on hours of work, the government has made no changes. The stipulation of the fixed working time is 7 hours a day and 40 hours during 6 working days, or 8 hours a day and 40 hours during 5 working days. The working time provisions do not apply to certain business sectors or jobs that are regulated by a government regulation (PP).

However, the government added a paragraph in the Ciptaker Law regarding working time, through Article 81 point 21 that modifies Article 77 of the Labor Law. The government establishes that the implementation of the working hours of workers or day laborers in a company is regulated in an employment contract, company regulation or collective bargaining agreement.

The President of the Confederation of Indonesian Workers’ Unions (KSPI), Said Iqbal, emphasized that the unions reject the ratification of the Ciptaker Law. One of the concerns of workers and day laborers is the working time that is considered exploitation.

“Working time continues to be exploitative. Workers refuse to work exploitative hours,” he said in an official statement.

As a result of the rejection of the Ciptaker Act, several unions in various regions threatened to go on strike on Tuesday (10/6). Said said that about 2 million workers from 32 union confederations and federations will go on a national strike. The action was carried out three days until Thursday, October 8.

“Demonstrations are held in each factory environment, stop production,” he said.
