Jakarta, CNBC Indonesia – Businessmen in the field of air transport welcome the existence of the Omnibus Employment Creation Law (Ciptaker). This is inseparable from the various amenities that airline entrepreneurs obtain through this regulation.
The president of the Indonesian National Air Carrier Association (INACA), Denon B. Prawiraatmadja, explained that there were a number of changes from previous regulations that had a direct impact on the aviation business.
“We all need to know that the main purpose of this Omnibus Law is to simplify the bureaucracy in the aviation industry,” he said on the sidelines of INACA’s Golden Anniversary event, on Thursday night (10/15/2020).
The simplification to which he refers refers to the elimination of a series of points from the previous regulation, specifically in Law Number 1 of 2009. In the old regulation, according to him, there were many regulations that were too technical but regulated by law.
“That’s why I see that in this Omnibus Law many very technical rules are changed in laws and in government regulations or ministerial regulations,” he explained.
He gave an example, for example, in Article 16 of the Aircraft Certification Act. Aircraft entering Indonesia are claimed to have an eligibility certification from the country of manufacture, which was previously regulated by law, but has now been transferred to government-stipulated regulation.
“So Article 42 on AOC ownership, the technical requirements that operators must meet to have an AOC permit that was previously regulated in Law Number 1 of 2009 is now regulated by the government,” Denon said.
“So now I see that things that are very technical in nature in the Omnibus Law are regulated in government regulations. These rules are expected to be very tailored to the situations needed at a time,” he continued.
In addition, he also opened his voice regarding article 118 regarding the minimum ownership of aircraft. In article 118 it is written that the ownership of the aircraft is at least 5 and then controlled by 5, so a total of 10 aircraft is at least.
“What is established in the Omnibus Law is actually a new regulation that will be determined by the government according to a certain classification,” he said.
He also stressed that the goal of this change is to make a rule that adapts to situations and locations. This, Denon said, is what the government believes is necessary to carry out aviation activities in certain areas like the eastern part of Indonesia.
“In the Omnibus Law I think there are many articles that have been bureaucratically simplified. We hope that in this Omnibus Law, in addition to improving the competition of airlines, but also as PSO, presenting public transportation services can support the national economy, ”said Denon.
He also hopes that the Omnibus Law will provide new encouragement to industry players, because it provides an adaptive simplification of bureaucracy.
