Markaz Syariah and PTPN VIII are currently discussing land ownership. The coordinating minister for Political, Legal and Security Affairs, Mahfud Md, said the land had not been abandoned for 30 years.
“In addition to the issue of the Megamendung land, which now belongs to the Islamic FPI boarding school, we will now solve the law itself, who used to buy it? Buy it from abandoned farmers, he said for 30 years,” Mahfud Md said in a virtual discussion at the YouTube channel of the KAHMI Council of Official Experts, as quoted on Monday (12/28/2020).
Mahfud emphasized that the HGU was awarded to PTPN VIII in 2008. This means that, Mahfud said, the land had not been abandoned for 30 years, as FPI claims.
“Loh, the government has only given HGU to PTPN VIII in 2008, not 30 years have passed. It means that PTPN has not served it for less than 30 years because the HGU was only obtained in 2008, if it is claimed in 2013, it means that it has only been 5 years since PTPN obtained the HGU from the government, “Mahfud added.
Mahfud has yet to speak about a solution to Markaz Syariah’s territorial controversy. Mahfud fully submitted the issue of the controversial Markaz Syariah vs PTPN VIII to applicable law.
“Now we will see, if I think like this, it is for the needs of the pesantren, so just go ahead for the needs of the pesantren. But then those who take care of it, for example Ulama Council, NU, Muhammadiyah, will join, even if FPI wants to join there, “said Mahfud.
“But I do not know the solution because it is a question of agrarian law, not a matter of political law in the sense of cases and security, but it is a legal problem in the sense that administrative law is in the land and BUMN, as well. go ahead. If the land has been neglected for 20 years and has been cultivated by a farmer or someone without question for 20 years, a certificate can be requested, “he explained.
Mahfud said that one had to find out in advance whether the farmers working on the land had existed for 20 years. However, Mahfud said that the 20-year period is not sufficient if it is calculated from the granting of HGU by the government to PTPN VIII.
