Jakarta, CNBC Indonesia – PT Trada Alam Minera Tbk (TRAM) President Commissioner Heru Hidayat voiced his objection to demands for a life sentence and 10 trillion rupees compensation. Reading the pledoi, Heru said that he did not enjoy the Rs 10 trillion in cash as the prosecutor alleges.
“Hearing these charges, I am like a despicable criminal who does not deserve a second chance. Has it really been proven that I have committed a crime that deserves to be prosecuted like this? Do I deserve a charge like this? Do I deserve this kind of treatment?” Heru said at a hearing at Jakarta Corruption Court, Jalan Bungur Besar Raya, Central Jakarta, on Thursday (10/22/2020).
Heru continued, he never enjoyed the money, even his current assets did not even reach 10 trillion rupees.
“In this trial, I was accused of obtaining and enjoying more than 10 trillion rupees and ordered to replace him. Even though all the assets that I have had from the beginning of the work until now have not even reached 10 trillion rupees. In this advanced and open era, it can be traced if I have assets of up to 10 trillion rupees. So where can I say that I received and enjoyed more than 10 trillion rupees? “said Heru.
For that, Heru said, there must be evidence showing the flow of money to him. Heru also said that none of the witnesses presented claimed that he had enjoyed 10 billion rupees.
According to Heru, the prosecutor’s claim that he enjoyed Rp10 billion was not proven.
“I am an ordinary citizen that with all his effort and hard work I started and pioneered my business so that these companies now become public companies, which include IIKP, TRAM and SMRU. That by becoming a public company, then the time these companies are not entirely mine. I am just a small part of the larger community that are now shareholders in these companies, “said Heru.
In his plea, he also apologized to his family and employees who lost their jobs due to this case. Heru hopes that the panel of judges will be able to decide this case fairly so that she can have the opportunity to be free and reunite with her family.
“I hope that the verdict of Your Excellency the Panel of Judges can restore the rights that are the result of the hard work of the community. I have high hopes that Your Excellency the Panel of Judges can grant my request, so that I may have the opportunity to be able to do better … again for my family, my employees and the whole community, “he said.
Last week, the prosecutor read the charges and claimed that Heru was proven guilty of a criminal act of money laundering (TPPU) by disguising the origin of the money he had corrupted by controlling shares of PT Asuransi Jiwasraya, one of whom played casinos and built Pinisi ships.
Prosecutors demanded that Heru Hidayat be sentenced to life in prison. Heru was also required to pay a fine of 5 billion rupees, a subsidiary of 1 year in prison.
The prosecutor believes that Heru has violated article 2, paragraph 1, together with article 18, paragraph 1, letter b, paragraph 2) and paragraph 3), of Law No. 31/1999 on the Eradication of Corruption, as amended by the Law No. 20/2001 of Amendments. on Law No. 31 of 1999 on the Eradication of Corruption in relation to Article 55 paragraph (1) 1 of the Penal Code.
Heru was also asked to pay a replacement fee of Rp 10,728,783,375. If Heru does not pay, his property will be confiscated until enough replacement money is paid.
