Jakarta –
A man similar to a convicted cocaine case, Richard Muljadi, running in Bali went viral on social media (medsos). The General Directorate of Corrections (Ditjen Pas) of the Ministry of Law and Human Rights stated that they had no authority to convict Richard.
The head of Public Relations and Protocol of the General Directorate of Pas, Rika Aprianti, said that her party did not have the authority because the judge decided that Richard should undergo rehabilitation.
“The person in question has been decided by rehab, not with us,” Rika said via text message on Saturday (10/17/2020).
It is known that Richard was convicted of using cocaine and sentenced to 1.5 years in prison. The judge ordered that the punishment be carried out with rehabilitation first.
Richard was rehabilitated at Cibubur Drug Addiction Hospital (RSKO) in East Jakarta. This verdict was decided by the judge in late February 2019.
“Imposing a criminal on behalf of Richard Muljadi with a sentence of 1 year and 6 months determines that the length of the period of detention previously served is deducted from the sentence that has been executed,” said the head of the panel of judges Krisnugroho while reading the verdict in South Jakarta District Court, Jl Ampera Raya, South Jakarta, Friday (2/28/2019).
“He ordered the defendant to undergo medication and treatment through medical rehabilitation and social rehabilitation at the RSKO rehabilitation center,” Krisnugroho added.
The panel of judges declared that it was proven that Richard Muljadi’s actions were a criminal act of drug abuse for himself, as regulated in article 127, paragraph 1, letter a, of Law No. 35 of 2009 on narcotics of the Republic of Indonesia.
What does the judge mean by ordering that the sentence be carried out with rehabilitation?
“It means he was sentenced to 1 year and 6 months. He was ordered to undergo rehabilitation until he was cured. The doctor knows how long he will recover,” said South Jakarta District Court Public Relations Officer (Jaksel) Achmad Guntur, to journalists on Thursday (2/28/2019).
If RSKO declares that Richard Muljadi is recovering from drug dependence before the end of the penal period, Richard will still have to serve a prison sentence.
“Subsequently, if he is declared cured by the doctor (but) he still has a pending sentence that has not been served, he must pass the sentence. The rehabilitation period is calculated as the period of prison compliance,” explained Guntur.
