LBH mentioned YouTuber Ferdian Paleka’s action to Transparency, not criminal

TEMPO.CO, Jakarta – LBH Jakarta Advocacy chief Nelson Nikodemus Simamora said the action of YouTuber Ferdian Paleka and his friends gave groceries containing trash to transpuanas rather than criminal acts. Because that action only violates ethics.

Therefore, Nelson believes that the police should not arrest Ferdian cs. “He has no punches, punctures, impersonations. There is no need to be convicted,” Nelson said when Tempo contacted him on Saturday, May 9, 2020.

Nelson said Ferdian’s actions could not be justified. But he said that not all the wrong things should be imprisoned, because the principle of criminal punishment is the ultimum remedium or last resort.

Compared to jailing him, Nelson said the police should be able to invite Ferdian to campaign for transparency rights so that the public can respect him more.

“Nowadays a bit of excitement stops on social media, I love the rubber article ITE Law, which is ‘hate speech’ or ‘insult.’ It is dangerous if our society takes this for granted,” Nelson said.

Ferdian became famous thanks to the content of the joke that degrades human dignity, especially to traffickers who are victims. Instead of doing good by giving groceries in times of trouble due to groceries, Ferdian filled the cardboard with garbage and bricks with the aim of embarrassing the transistors.

Ferdian Paleka was arrested by the police on the Tangerang – Merak toll road after trying to escape on Friday, May 8, 2020. At the time, he was with a friend and his uncle. Ferdian cs was accused of Article 36 of the ITE Law and Article 51 paragraph 2 with a sentence of 4 to 12 years in prison.
