JAKARTA, KOMPAS.com – President Joko Widodo mentioned a lot of misinformation and jokes that cause the Creation Labor Law to be rejected by the public.
One of them is about the environmental impact analysis document (Amdal) that the company must keep.
Jokowi emphasized that Amdal was not abolished. Companies whose businesses are considered to have a significant impact on the environment must have this document from Amdal.

“What is also often misreported is the removal of environmental impacts analysis. That is also not true. Amdal still exists for large industries, there must be rigorous EIA studies,” Jokowi said.
“But for MSMEs, the emphasis is more on assistance and supervision,” he continued.
What are the facts?
To verify the norms related to EIA, the new Employment Creation Law approved must be compared with Law Number 32 of 2009 on Environmental Protection and Management (PPLH).
This is because the Employment Creation Law changes several rules of the PPLH Law. One of them is article 26 PPLH which is related to Amdal.

This article states that the development of the EIA document involves the community and is based on the principle of providing transparent information.
In addition, affected people and environmentalists can file objections to this Amdal document.
However, this provision was modified so that the preparation of the Amdal document was carried out involving only those directly affected.
Under the Copyright Law, environmental observers no longer participate.

In article 26 too, there is a verse that gives the public the right to object to the Amdal documents. But in the Omnibus Law, this ruling verse is lost.
Then, articles 29-31 of the PPLH Law that regulates the Amdal Evaluation Commission, which also includes experts and representatives of the community and environmental organizations, are eliminated.
The functions of the commission were replaced by a due diligence team formed by the Central Government’s Feasibility Testing Agency. There are only three elements, namely the central government, local governments, and certified experts.
