PT Hanson International Commissioner Benny Tjokrosaputro is being charged with life imprisonment and a 5 billion rupee fine, a subsidiary of 1 year in prison. The prosecutor believes Benny is guilty of corruption and enriched himself in collaboration with three former Jiwasraya officials worth Rs 16 trillion.
“Demand that in this case the panel of judges of the Corruption Court of the Central Jakarta District Court shall fail to decide: Declare that it has been legally and convincingly proven that the defendant is guilty of joint corruption and money laundering,” said the prosecutor , KMS Roni, at the Jakarta Corruption Court, Jalan Bungur Besar Raya, Central Jakarta, Thursday (10/15/2020).
“Sentenced to life imprisonment, a fine of 5 billion rupees, subsidiary of 1 year in prison,” said the prosecutor.
Benny Tjokro must also pay a replacement fee of Rs 6,078,500,000,000.
The prosecutor believes that Benny violated article 2, paragraph 1, together with article 18, paragraph 1, letter b, paragraph 2) and paragraph 3, of Law No. 31/1999 on the Eradication of Corruption, as amended by the Law No. 20 of 2001 regarding the amendments to Law No. 31 of 1999 regarding the eradication of corruption in relation to article 55 paragraph 1) 1 of the Penal Code.
The prosecutor revealed that Benny Tjokro and Heru Hidayat were working together on this corruption. The prosecutor said that Benny and Heru were shown to have collaborated in controlling the actions in an unnatural way.
“The defendant Heru Hidayat and Benny Tjokro reached an agreement by selling and buying shares to increase the price of certain shares such as SMRU, IKP, Tram, MRYX by controlling the shares controlled by the people of Heru Hidayat and Benny Tjokro so that the price of the action will increase as if it were according to demand. “Reasonable actions, although regulated by certain parties. After the shares rose unnaturally, then Benny Tjokro and Heru Hidayat sold the shares to PT AJS (Asuransi Jiwasraya), “the prosecutor explained.
In this case, the prosecutor said that the state lost Rs 16 trillion in control of the shares of Benny Tjokro and others and three former Jiwasraya officials.
“So it was found that state losses on equity investments amounted to Rp 4,650,283,375,000 and state losses on mutual fund investments amounted to Rp 12,157 billion, so that total state losses as a whole were 16,807. 283,375,000.00 trillion, “said the prosecutor.
Furthermore, the prosecutor believes that Benny Tjokro and Heru Hidayat have also committed the crime of money laundering (TPPU). The prosecutor believes that Benny and Heru hid their assets by buying assets.
The money laundering actions that the two carried out were disguised by buying land and buying and selling shares. This was done in collaboration with various parties.
Therefore, we believe that the object of placing, transferring, transferring, spending, paying, granting, entrusting, taking abroad, changing form, exchanging currency or securities or others has been proven, “said the prosecutor.
Therefore, Benny and Heru also violated Article 3 of Law No. 8/2010 on the Prevention and Eradication of the Crime of Money Laundering.
