ITE Law Suspect Ustaz Maaher Faces 6 Years in Prison

The head of the Public Information Office of the National Police (Karopenmas), Brigadier General Awi Setiono, explained that the suspect, Soni Eranata, alias ustaz Maaher At-Thuwailib threatened with six years in prison for the case that caught him.

Awi explained that the police have put the preacher with the article enshrined in the Law of Transactions and Electronic Information (ITE).

“With the threat of 6 years in prison and / or a maximum fine of 1 billion rupees,” Awi told reporters at the Jakarta Police Headquarters on Thursday (March 12).

He said that Maaher was suspected of committing a criminal act of disseminating information aimed at generating hatred, enmity, certain persons or groups of persons based on SARA.

Maaher allegedly insulted Lutfhi bin Ali bin Yahya by uploading a photo wearing a white turban. Maaher then gave a statement: ‘Yes, wearing a hijab, I think this banser is more beautiful.’

As for, the suspect was trapped in 45 paragraph 2 of article 28 paragraph 2 of Law number 19 of 2016 on changes to Law number 11 of 2008 on ITE.

The arrest was made after Waluyo Wasis Nugroho’s report on November 27 was received by the police and continued until the investigation process.

“In the modus operandi, the suspect uploaded Sara’s content to the suspect’s Twitter account. Meanwhile, the motive is still being deepened,” he said.

Awi has not been able to confirm whether the investigator has decided to detain the suspect or not. The reason is, he said, that the police have 1 x 24 hours after the arrest to conclude this.

“Because this morning 04.00 WIB at the moment, we are still awaiting the decision of the investigators. But what is clear is that the person in question has been named a suspect, ”he said.
