JAKARTA, KOMPAS.TV – The Institute for Criminal Justice Reform (ICJR) highlighted the determination of the alleged artist Gisella Anastasia (GA) alias Gisel and MYD in the case of pornography.
ICJR investigator Maidina Rahmawati said Polda Metro Jaya’s determination of the GA and MYD suspects was incorrect.
“The basic note in this case is that whoever is in the video, if he does not want it to be disseminated to the public at all, cannot be convicted,” he said in a written statement on Tuesday (12/29/2020).

In addition, Maidina detailed, First in the context of the application of the Pornography Law, that the person in the video who does not wish to distribute the video cannot be convicted.
According to him, there is an important limitation in the Pornography Law, that the parties who commit the act of “doing” in article 4 of Law No. 44 of 2008 on Pornography cannot be sanctioned if they do it for their own purposes and personal interests.
Therefore, the act of doing pornography cannot be punished if it is done for one’s own interests or personal gain.
