LIVE – The former president of the Constitutional Court, Hamdan Zoelva, responded to the issuance of an instruction by the interior minister saying that the government could remove regional chiefs if it was shown that they had violated health protocols. Hamdan believes this is not true.
“The Interior Minister cannot fire the regional chiefs,” he said via his Twitter account, @hamdanzoelva, on Friday, November 20, 2020.

Hamdan said the dismissal must go through a lengthy process at the DPRD and be decided by Mahamah Agung.
It transmitted that according to the Regional Government Law, a regional head can be dismissed for certain causes, initiated by the Special Commission for questionnaire or questioning rights DPRD, approved by the plenary session of the DPRD and submitted to the Supreme Court.
“The Supreme Court decides the removal of the regional chiefs,” he said.
Previously, the Minister of the Interior, Muhammad Tito Karnavian, issued the Instruction of the Minister of the Interior number 6 of 2020 on the fulfillment of health protocols to control COVID-19. The Interior Minister also recalled the sanctions for regional chiefs who ignore their obligations.
According to the Director General of Regional Administration, Safrizal, the Interior Minister’s instruction is a follow-up to the directives of President Joko Widodo at a closed-door cabinet meeting on Monday, November 16, 2020 at Merdeka Palace, Jakarta. Jokowi emphasized the importance of consistency in complying with the COVID-19 health protocol and prioritizing the safety of people.
