YAKARTA, KOMPAS.com – PT Bumi Empon Mustiko, the buyer of 72 registered trademarks of Nyonya Meneer, was sued by Charles Saerang, the heir to the founder of the legendary medicinal herb factory, before the Semarang Commercial Court for alleged copyright infringement.

The third descendant of the founder of Nyonya Meneer did not accept the installation of the photo of Nyonya Meneer on curtain oil products produced by PT Bumi Empon Mustiko.

Semarang Commercial Court spokesman Eko Budi Supriyanto in Semarang on Tuesday confirmed the registration of the lawsuit for the case.

“He has been admitted and processed by the panel of judges that will judge the case,” he said, as quoted by Between, Wednesday (05/13/2020).

The civil copyright infringement lawsuit was filed against PT Bumi Empon Mustiko regarding the installation of photos of Ms. Meneer on the packaging of the company’s curtain oil products.

In the lawsuit registered with the registration number 2 / Pdt.Sus-HKI / Cipta / 2020 / PNNiagaSmg, Charles demanded that the production of curtain oil stop and attract those already circulating in the market that contained photographs of Lauw Ping Nio or Mrs. Meneer.

PT Bumi Empon Mustiko bought 72 trademarks of PT Perindustrian Nyonya Meneer after the herbal medicine company was declared bankrupt in 2017.

PT Bumi as the defendant is deemed not to have the right to include Ms. Meneer’s photos in his products.

In his lawsuit, Charles Saerang also requested material and immaterial compensation totaling Rp 543 billion.

For information, after being declared bankrupt by the court, Nyamu Meneer’s medicinal herb brands were transferred to PT Bhumi Empon Mustiko.

PT Bhumi Empon Mustiko is a joint venture between the heirs of Ms Meneer and PT Ahabe Niaga Selaras.

The plaintiffs said they did not care that PT Bumi Empon Mustiko used the Nyonya Meneer brand, after the company purchased 72 trademarks after Nyonya Meneer filed for bankruptcy in 2017.

However, Ms. Meneer’s photo installation was deemed not included in the agreement to purchase a brand after the plaintiff’s company was declared bankrupt.

In order to use Ms. Meneer’s photo, PT Bumi Empon Mustiko must first obtain permission from the heirs.
