JAKARTA, KOMPAS.com – Esports athlete Winda D Lunardi aka Winda Earl and her mother, Floletta Lizzy Wiguna, who lost 22 billion IDRs, recently went viral. The money was lost in one of the banks, Maybank Indonesia.

The missing money case was finally resolved at the level of the law. Winda reported the incident to the police and registered under number LP / B / 0239 / V / 2020 / Bareskrim on May 8, 2020.

Meanwhile, Maybank Indonesia wants the matter to be resolved in court. The famous lawyer Hotman Paris was appointed a lawyer for the Malaysian bank.

The case of Winda Earl’s loss of money was only revealed to the public when Winda visited the Criminal Investigation Building of the National Police to learn of the progress of the investigation into the case of the alleged banking crimes that happened to her and her mother. , Floletta.

Where did the case start?

The case of the disappearance of the saved money belonging to the e-Sport athlete started when the victim arrived at Maybank Indonesia in Cipulir, in South Jakarta.

Winda was offered by the perpetrator with the initials A who was also the head of the branch to open a deposit in the form of a time account. The victim is tempted because the deposit interest offered by actor A is relatively high compared to bank savings products in general.

It was later discovered that Perpetrator A did not actually create a term account as promised at Maybank. The suspect falsified all the data to make the victim believe that he had already opened a fixed bank account.

Subsequently, the victim’s money was withdrawn without the victim’s knowledge and permission. The perpetrator then transferred the victim’s money to his fellow suspects, then tapped it in hopes of making a profit.

The victim herself only learned that the perpetrator had used her money when she discovered that only Rp600,000 was left in her account. Meanwhile, the mother’s account only left 17 million rupees.

It is not a new case

PT Bank Maybank Indonesia Tbk’s lawyer, Hotman Paris Hutapea, said the case of losing Winda Earl’s money was not new.

Hotman said that the case of emptying Winda’s accounts had occurred since May 2016. Winda himself filed a complaint with Maybank Indonesia on February 17, 2020 and ended with a police investigation in May 2020.

Hotman continued, this case is somewhat complicated. There are many issues in the case of loss of client funds that are not widely known to the public. You also always consider the cases you defend with careful consideration.

This is also the reason why Maybank Indonesia has the courage to take its solution to court. The case you are handling does not only concern the alleged theft.

“This case is not as simple as suspected. There are things you do not know, not only the alleged robbery. We will await the decision of the authorities,” said Hotman.

What has Maybank been up to all this time?

Hotman said Maybank Indonesia immediately launched an investigation when it learned of the lost money case.

The company admits that it has also reported the alleged criminal act to the police. The police have followed the Maybank Indonesia report and now the criminals have been arrested.

In addition, the Criminal Investigation Unit of the National Police named Maybank Section Chief Cipulir with the initials A as a suspect in the case of the loss of money in the accounts of Winda Earl and her mother.

Investigators are currently tracking Suspect A’s assets from the proceeds of his crime. Identified assets will also be confiscated.

Hotman said there were irregularities.

According to Maybank, this theft case has 6 oddities. The first oddity was when Winda did not request a passbook or an ATM from the bank. Until now, Winda’s passbook has been kept by the branch manager with the initials A, who is currently a suspect.

However, according to the evidence, Winda received a passbook and an ATM, as evidenced by the date of receipt of the passbook and the ATM account.

At that time, Winda opened a savings account on October 27, 2014 using the transfer method of Herman Lunardi, who is her father, with a nominal transfer of Rp. 2 billion.

Until the case was revealed, Winda’s money in the account amounted to Rp.17.9 billion, all of which were transferred through her father’s account.

“He signed (that) the passbook and ATM have been received, but the branch manager has been holding them. And the customer has never complained or complained about it. You, as the owner of the money, Why let other people keep the passbook and the ATM? ” Hotman said.

Then after that, an account was opened in the name of Floletta Lizzy Wiguna, who is Winda’s biological mother. When opening a savings account, there was a transfer of IDR 5 billion from her husband, namely Herman Lunardi, to open an account. In total, Winda and Floletta’s savings amounted to Rs 22.9 billion.

The second oddity can be seen in the transferred bank interest. At the time, Maybank promised an interest rate of around 7 percent.

But interestingly, the interest payments were made from the suspect’s personal account with the initials A, from A’s account at Maybank, and from A’s account at BCA Bank. The transfer was not made to Winda’s account, but to the account of her father, Herman Lunardi.

“There was a protest from the account owner that the interest on my savings was paid from a personal account of the branch manager. There was no protest,” Hotman said.

Another oddity is that the interest payment is not as promised. Supposedly, the interest payment on deposits in the 2014-2016 period was 1.2 billion IDR. However, what the suspect paid was just IDR 567 million.

He was playing the policy before it entered his father’s account.

The next oddity is when there is a policy purchase transaction on behalf of Winda at Prudential. The policy was bought by the suspect, who incidentally was the Head of the Maybank Cipulir Branch with the initials A.

However, in a matter of months, the money that he bought for the policy was transferred back to his father’s account, namely Herman Lunardi, worth Rs 4.8 billion. This transfer can be seen in the account mutations analyzed by the anti-fraud team.

Hotman suspects the possibility exists for branch leaders to practice banking within the bank. This is demonstrated by the ease with which branch managers access winda accounts to drain their money.

“So 6 billion rupees from Winda’s personal account, just a count of how many months the money will go back to her father’s account, as seen by the mutation of the account,” said Hotman.

Compensation depends on the results of the investigation.

Due to these oddities, Maybank is awaiting the results of the investigation before offsetting the losses. Because at this time, it is not clear which party was involved in the theft case.

“It will be returned if it is clear who was involved. If you are involved, I (must) return it. If true, yes, Maybank will pay. If not, just pay the period,” Hotman said.

Hotman questioned why there was any involvement in the Rp 22 billion disappearance with the account owner and Winda’s family.

However, Hotman did not charge the related individuals with committing a crime. His party asked investigators to directly convene parties involved in the money flow to account.

Aside from Winda’s father, Herman Lunardi, several names were recorded as having received the flow of funds. Some of them are relatives of the suspect with the initials A, who is the Head of the Maybank Cipulir Branch.

“There are many who receive the flow of funds. They are 6 in number (aside from Winda and her father). Among other things, he is the brother of the branch manager (Cipulir), ”said Hotman.

For that, Maybank is awaiting the legal process to find out who is involved. Therefore, the funds in the bank are Third Party Funds (DPK) that must be accounted for both for the community (clients) and for the central office.

“We do not charge any of the related persons for criminal acts. But it would be very remiss if the directors (Maybank management) simply paid if it is not clear (the perpetrators). The directors could be fired by the head office because (the payments ) cannot be accounted for, “concluded Hotman.
