Found guilty in the Jiwasraya case, Benny Tjokro was sentenced to life in prison

JAKARTA, KOMPAS.com – President Director of PT Hanson International Tbk Benny Tjokrosaputro, sentenced to life imprisonment in the corruption case of PT Asuransi Jiwasraya (Persero).

The panel of judges assessed that Benny Tjokro was found guilty of committing corruption to the point of causing a loss of 16.807 trillion rupees in state finances and of committing the crime of money laundering (TPPU).

“Sentence the defendant to life imprisonment,” Chief Judge Rosmina said at the Corruption Court in Jakarta on Monday (10/26/2020), cited by Between.

The verdict is the same as the demands of the public prosecutor (JPU), namely life imprisonment and a fine of 5 billion rupees, subsidiary of 1 year in prison.

Furthermore, Benny was also sentenced to an additional punishment, namely the payment of a replacement fee of Rs 6,078,500,000,000.

“As long as within a month after the court’s decision has permanent legal force and the defendant does not pay the replacement money, their property will be confiscated and auctioned to cover the replacement money,” Rosmina said.

According to the panel of judges, what was burdensome for Benny was corruption in a well-organized manner that made it difficult to reveal his actions.

The judging panel then revealed that Benny used a host of other parties as nominees and even used fake ID cards and used companies that had no activities to accommodate his business.

Another thing is that Benny’s actions were carried out for a long time and caused losses to the state and Jiwasraya clients.

“Although the accused was educated and was the head of the family, the accused did not feel guilty and did not regret it, so the polite attitude and the status of the head of the family were erased with a sense of innocence and he did not regret their actions, ”said Rosmina.

The verdict is based on the first accusation of article 2 paragraph (1) in conjunction with article 18 of Law Number 31 of 1999 modified by Law Number 20 of 2001 regarding the Eradication of Corruption in conjunction with article 55 paragraph (1) first of the Penal Code and the second of article 3 of Law Number 8 of 2010 relative to the Prevention and Eradication of ML.

The other four defendants in this case have also been sentenced to life in prison.

The four consist of former Jiwasraya CEO Hendrisman Rahim; former Jiwasraya CFO Hary Prasetyo; Former Director of Jiwasraya Investment and Finance Division, Syahmirwan; as well as the Director of PT Maxima Integra Joko Hartono Tirto.

They were also found guilty of corruption that led to a loss of Rs 16.807 trillion in state finances in the Jiwasraya case.
