Duplicate Ministerial Department-Walkot, Violation of Law

Jakarta, CNBC Indonesia – President Joko Widodo (Jokowi) appointed Tri Rismaharini as Minister of Social Affairs to replace Juliari Batubara, who is involved in a corruption case in the Covid-19 social assistance fund.

Although he is a member of the Indonesian Advanced Cabinet, Risma still has the status of Mayor of Surabaya. As for Risma, so far Risma has not carried out the transfer of the position of mayor.

This is because the Governor of East Java, Khofifah Indar Parawansa, has sent an assignment letter to the Deputy Mayor of Surabaya, Whisnu Sakti Buana, to become the Acting Mayor (Plt) of Surabaya.

The political observer from Indonesia’s Al Azhar University, Ujang Komarudin, assessed that the concurrent office of Tri Rismaharini, who has not resigned as mayor of Surabaya, is not constitutionally permissible.

“Duplicate departments are not allowed for state offices, that violates the Law (Law),” Ujang said, as quoted on Saturday (12/26/2020).

Ujang reveals that the rules that are violated are article 76 paragraph (1) letter h of Law No. 23 of 2014 on Local Government. In the law there is a prohibition not to accumulate positions in other departments.
