DPR Baleg: This is the first time that a law has been incorrectly written after it has been signed by the president

JAKARTA, KOMPAS.com – The Chairman of the Body of Legislation (Baleg) DPR Supratman Andi Agtas stated that the DPR would contact the government to correct the written omissions in the Employment Creation Law.

Supratman emphasized that DPR is ready to take responsibility that these improvements do not change the essence of the law.

“DPR is ready to do that and is ready to take responsibility that it does not change the essence of the Job Creation Act at all. Because it is a purely administrative error,” Supratman said when contacted Wednesday (4/11 / 2020).

According to him, the writing error that occurred in article 6 and article 175, point 6, can still be corrected.

Supratman said correcting typographical errors in the text of the law has become a concession in itself.

Although it is not explicitly regulated in Law Number 12 of 2011 on the Formation of Legislation, he said that there was an agreement that revisions to the Law can be made after its approval, as long as the fund does not change.

“The PPP Law does not explicitly regulate. What we agree on is that there should be no changes after the end of the plenary session in terms of substance. But editorial improvements have been made, it has always been that way, ”Supratman said.

However, Supratman admitted that this was the first time negligence in drafting the law was discovered after it was signed by the president.

In previous cases, the negligence was discovered before the president signed it. However, he found corrections to word errors to be commonplace.

Furthermore, negligence in drafting the Employment Creation Law is considered only an administrative error.

“In fact, after being signed by the president, it is the first time that it is done, but before the president signs, almost all the laws are like that. Because the secretary of state must read it first. Then a mechanism is always made. called correction of typos and such, “he said.

Previously, the Minister of State, Secretary Pratikno said that he had asked the General Secretariat of the RPD to respond to the improvement of Law Number 11 of 2020 on Job Creation.

This was transmitted by Pratikno in response to a typo in the Employment Creation Act.

“The Secretariat of the Ministry of State has also moved to the General Secretariat of the DPR to agree on reparations,” Pratikno said in a press release on Tuesday (03/11/2020).

Pratikno also considered that the formulation error in the Employment Creation Law was limited only to administrative problems. He assured that the error did not affect the implementation of the Employment Creation Law.

Meanwhile, constitutional law observer Bivitri Susanti claimed that wording errors in the Job Creation Law cannot be corrected carelessly.

He encouraged the government to issue government regulations instead of laws (perppu) to provide legal certainty so that these articles can be implemented.

“If the government wants to provide legal certainty so that the articles can be implemented, it can issue a Perppu. Because this law cannot be changed like that,” Bivitri said on Tuesday (03/11/2020).
