Jakarta, CNN Indonesia –

Members of the Body of Legislation (Baleg) DPR RI of a faction Democratic party Hinca Panjaitan mentions the Alcoholic Beverage Ban Project (RUU Minol) overkriminalisasi.

According to him, the draft regulation shows that the problem of the criminal justice system with a cost-benefit approach based on a regulation that will be formed has never been adequately positioned.

“Overcriminalization. This will be reflected in my image of the Minol Bill,” Hinca said. CNNIndonesia.com, Friday (11/13).

He said Indonesia was talkative in the formation of legal products with a large cloak of bans after the reform era. He admitted that he was concerned that the good intentions to suppress the crime rate through the Minol Project would run counter to the results that would be achieved.

Hinca believes that the Minol Bill containing criminal penalties or fines for people who consume minol has the potential to repeat the errors of Law No. 35 of 2009 on Narcotic Drugs.

According to him, the criminal sanctions of the Narcotics Law have resulted in overcrowded prisons, breached human rights instruments and wasteful budgets.

“Rehabilitation of drug addicts in this country is still far from feasible. Rehabilitation centers are still minimal available, addiction counselors are still very few, as well as insufficient budgets to support addiction healing programs. they are very big, “said the member. The Legal Commission of the DPR.

Earlier, the Institute for Criminal Justice Reform (ICJR) made a similar statement, which was aware of the possibility of excessive criminalization that could occur if the Minol bill is passed into law.

On this basis, the Executive Director of the ICJR, Erasmus Napitupulu, is of the opinion that the draft prohibition of alcoholic beverages does not need to be discussed by the DPR.

“The approach to ban alcoholic beverages may have a negative impact on criminal justice in Indonesia,” Erasmus said in an ICJR statement on Wednesday (11/11).

Meanwhile, a member of DPR Baleg from the Golkar Party faction, Firman Soebagyo, called for the Minol bill to be discussed with the government. According to him, the government’s opinion on the importance of making two draft regulations must first be communicated.

Meanwhile, the vice-speaker of the Indonesian parliament, Sufmi Dasco Ahmad, assured that DPR Baleg will pay attention to various objections and comments from the public regarding the Minol bill.

The discussion on the Minol bill is currently only in the stage of explanation of the proposals for the draft regulation. Dasco said Baleg will first review the proponent’s explanation and determine whether or not the discussion on the Minol Bill will continue.
