Jakarta, CNBC Indonesia – The defendant in the case of alleged corruption of PT Asuransi Jiwasraya (Persero) Benny Tjokrosaputro, who is the CEO of PT Hanson International Tbk (MYRX), will be sentenced to life imprisonment.
Furthermore, Bentjok, as he is usually called, was also asked to pay state losses worth 6 billion 78 billion 500 million rupees (Rp 6.078 billion) in this case.
However, Bentjok’s legal counsel, Bob Hasan, said the trial needed to incorporate other elements suspected of being involved, including the possibility that the Bakrie Group was considered the mastermind.
“For a healthy judgment, the issuer summons, the Bakrie Group summons, the sin is that only Bentjok is summoned. Bentjok only has MYRX and it cannot be controlled because it has 5 thousand shareholders. Including Asabri and Jiwasraya. What can control the Bentjok nominees [rekening nama alias] wrote, “Bob said after the impeachment trial in Jakarta’s Central District Court on Thursday night (10/15).
“So don’t use it on behalf of MYRX, then all MYRX is controlled by Bentjok,” he said.

He also explained how these stocks could initially register a loss of inventory. However, he was reluctant to admit that his client was the mastermind behind Jiwasraya’s investment losses.
“There may be two, Heru Hidayat and Benny Tjokro continue to collaborate. 2008, 2010, 2012 there is no Benny Tjokro. 2015 only exists. It is a repo [gadai saham] with Heru Hidayat. Heru Hidayat sold it to Jiwasraya. That’s really the way Jiwasraya’s actions are fat not liquid. Why? because the transaction is pseudo. Who is doing is certainly not my client. My client is a victim, “said Bob.
“But my client makes up for it [tebus repo] 2016. So MYRX’s activity is to buy Jiwasraya shares through Mr. Benny’s nominee. 2017 has nothing to do with Mr. Benny, MYRX shares held by thousands of people. [Termasuk] Asabri all transactions with Jiwasraya. Not Mr. Benny who controls it, “he continued.
On the other hand, Bob also highlighted how the demands of the Public Prosecutor’s Office (JPU) seemed strange.
“A lifetime claim compared to Perma [Peraturan Mahkamah Agung] 1 of 2020 that the procedural law that the prosecutor can sue for life I think is something new. It is not something that usually happens. The prosecutor will prosecute as much as possible, but we have to look at the similarities of actions and others, “said Bob.
At the impeachment hearing, on Thursday night (10/15) until 11 pm WIB, the prosecutor stated that the defendant Benny Tjokrosaputro was legally and convincingly convicted of having committed a criminal act of corruption altogether.
Therefore, the defendant was sentenced to life imprisonment by order of the defendant to remain detained in the state detention center.
He paid a fine of IDR 5 billion, a subsidiary for 1 year in prison.
Furthermore, Bentjok was also asked to pay a replacement fee of 6 billion 78 billion 500 million (Rp 6.078 billion).
“If the defendant does not pay the replacement money within 1 month after the judgment of the court of law, the prosecutor will confiscate the property and it will voluntarily become the replacement money,” the prosecutor said when reading the charges, Thursday for the night (10/15).
Regarding the charges against Heru Hidayat (another defendant in the same trial), that is, claiming that Heru Hidayat was legally and convincingly found guilty of joint corruption and money laundering (TPPU).
Furthermore, the defendant Heru Hidayat sentenced him to life imprisonment and a fine of Rs 5,000 million, a subsidiary of 1 year in prison with the order that the defendant remain in detention.
Replacement money paid of 10 billion 728 billion 783 375 thousand rupees (Rp 10.728 billion).
Therefore, the amount of compensation for both reached Rs 16.81 trillion.
This amount is the same as the total potential state loss as calculated by the Higher Audit Agency (BPK), ie 16.81 trillion rupees.
Earlier, on October 12, the charges were read to four other Jiwasraya defendants with the maximum penalty, namely life imprisonment.
About Bakrie, before that, On Wednesday (6/24/2020), Bentjok accused BPK of covering up the Bakrie Group’s involvement in the Jiwasraya case.
“The BPK covered it up. The one who covered the BPK president and vice president was definitely Bakrie’s crony. He was the one who covered it up. In fact, the BPK president and vice president did the cover,” Bentjok explained.
Suddenly, BPK president Agung Firman Sampurna said that Bentjok deliberately defamed him. Agung countered by saying that Bentjok diverted the Jiwasraya Insurance mega corruption case that is currently in the trial process.
Agung emphasized that the defamation committed by Bentjok has been reported by his party to the Criminal Investigation Agency and still continues.
According to Agung, what Bentjok did was not only defame BPK, but also provide false information.
“If they say that protecting and so forth is false information, it is an effort to smear and an attempt to obscure the real case that we all know about,” he said in the DPD RI building on Thursday (7/16/2020).
