Fahmi explained that in Indonesia there are only two institutions that can have armed forces, namely the TNI and Polri.

TNI, Fahmi explained, is the main component of the state to defend sovereignty, maintain defense and carry out the duties and functions of military operations. TNIs can also conduct military operations other than war.

Meanwhile, the National Police is a law enforcement agency and a law enforcement and security agency.

“These two institutions or organizations have a constitutional mandate as armed forces with offensive powers,” he said.

Fahmi recognized that BIN has a security function as regulated in Law no. 17 of 2011. However, this does not mean that BIN can have armed forces.

According to Fahmi, there must still be an article or paragraph in the Law that clearly regulates it. This is because the referenced security activity is within the scope of the intelligence function.

“Because this is a security activity that falls within the scope of the intelligence function. Nothing else,” Fahmi said.

In Law No. 17 of 2011 and Presidential Decree No. 73 of 2017, it is established that BIN has the function of investigation, security and extortion. But no article or sentence that explicitly mentions BIN can have an armed force.

Since July 2020, BIN reports directly to the President of the Republic of Indonesia, Joko Widodo, from the beginning under the coordination of the Ministry of Coordination of Political, Legal and Security Affairs (Kemenkopolhukam). This change was formalized through Presidential Regulation (Perpres) Number 73 of 2020.

Fahmi then questioned the purpose of the BIN-formed Rajawali special forces. This is because BIN has been an intelligence agency with many of its members even from civilian circles.

“Now this is the troop made up of BIN, where is its position? Is BIN being designed as a ‘fifth force’,” Fahmi said.

Fahmi also criticized BIN for developing the organization and improving its performance. Instead of building a world-class intelligence organization, according to Fahmi, BIN is moving in a confusing direction.

In addition, the BIN special forces emerged whose legal basis for their formation was unclear.

“It is not clear, is this institution disguising itself as an army, becoming a police officer or just a fan of ‘cosplay’?” Fahmi said.

Previously, the existence of the Rajawali special forces was known from the video uploaded by the President of the People’s Consultative Assembly (MPR) Bambang Soesatyo through his personal Instagram account @ bambang.soesatyo.

In the video, troops are seen demonstrating military action in front of several TNI generals present. It is not known whether the Rajawali special forces consist of personnel from TNI, Polri or BIN.

Rajawali’s troop attraction was displayed in front of BIN Chief of General (Purn) Budi Gunawan, Chairman of the People’s Consultative Assembly (MPR) Bambang Soesetyo, Chairman of the People’s Representative Council (DPR) Puan Maharani, Secretary of Cabinet Pramono Anung, Chairman of Commission I DPR Meutya Hafid, and Deputy Minister of Defense (Wamenhan) Sakti Wahyu Trenggono.
