Ministry of Agriculture (Department of agriculture) by Decree of the Minister of Agriculture of the Republic of Indonesia Number 104 / KPTS / HK.140 / M / 2/2020 on commodities assisted by the Ministry of Agriculture, marijuana as one of the medicinal plants under the direction of the General Director of Horticulture.
Despite being listed as 1 of the 66 medicinal plants built, the Director of Processing and Marketing of Horticultural Products of the Ministry of Agriculture, Bambang Sugiharto, said that marijuana is still illegal in Indonesia. Either as a medicinal plant or for free consumption.
“It is not legalized. It is still prohibited, although there is medicinal cannabis, but in Indonesia it does not legalize the cannabis plant. There is a statement, it is not cultivated,” Bambang told CNNIndonesia.com, Saturday (8/29).
He emphasized that the promoted list was issued to list the plants that were supervised by the Ministry of Agriculture and not cultivated.
“It’s not that it’s legal to go in there, no, not at all,” he continued.
If it is legalized, according to Bambang, it will violate Law No. 35 of 2009 on Narcotic Drugs. Marijuana itself is classified as a class I narcotic along with methamphetamine, cocaine, opium, and heroin. Permission to use class I narcotics is only allowed in certain cases.
Law Number 35/2009 also prohibits the consumption, production and distribution of group I narcotics.
Anyone who produces or distributes Class I narcotics is subject to imprisonment up to a maximum of life or death. Meanwhile, Class I narcotic abusers are subject to a maximum sentence of 4 years.
Marijuana is still under the supervision of the Ministry of Agriculture, but Bambang said there was no plan for the Ministry of Agriculture to grow cannabis as a medicinal plant.
“It is not allowed to violate the law, only the Ministry of Agriculture,” he concluded.
The MOA also stipulates that other types of medicinal plants will be encouraged, including amethyst, noni, kratom, brotowali, and purwoceng.
The annex to the Ministerial Decree also contains the types of plants and livestock that are included in the basic products of the Ministry of Agriculture.
The General Directorate of Planting, for example, contains 140 types of garden plants that are included in the target products. These plants include quinine, andaliman, kolesom, vanilla, and ginger.
