Jokowi presidential decree: people with disabilities or deaths from the Covid-19 vaccine receive compensation

JAKARTA, KOMPAS.com – President Joko Widodo signed Presidential Decree No. 14/2021 as an amendment to Presidential Decree No. 99/2020 on the Acquisition of Vaccines in the Context of the Corona Virus Disease Pandemic.

The Perpres, which was signed on February 9, 2021, contains a number of changes, the abolition of old regulations and the addition of new regulations.

Quoted from the Presidential Decree that was uploaded to the official website of the Secretary of State on Saturday (2/13/2021), one of the new regulations, namely the issue of compensation for vaccination participants who experience disabilities or die after being injected with the COVID-19 vaccine.

The regulations are listed in article 15B of Presidential Decree No. 14 of 2021. The details are as follows:

Article 15B

(1) In the event that there is a post-vaccination follow-up case that is affected by the COVID-19 vaccine product based on the results of the causation study referred to in article 15A paragraph (3) and the causes of the In the event of disability or death, the Government will grant compensation.

(2) The compensation referred to in paragraph (1) shall be in the form of compensation for disability or compensation for death.

(3) The Minister of Health shall establish other provisions regarding the criteria, form and value of the amount of compensation referred to in paragraph (1) after obtaining the approval of the Minister of Finance.

Meanwhile, in the case of a follow-up after vaccination that requires medication and medical attention, the government also regulates the provisions.

The aforementioned provisions are contained in article 15A, paragraph 4). The article says:

For cases of follow-up events after vaccination with Covid-19 as mentioned in paragraph (1), the treatment and treatment are carried out according to the medical indications and treatment protocols, then the cost of the Treatment and care is provided whenever:

a. for active participants of the National Health Insurance Program, covered through the National Health Insurance mechanism and

B. For non-active participants of the National Health Insurance Program and who are not participants of the National Health Insurance Program, it is financed through other financing mechanisms that originate in the state income and expenditure budget that is implemented in accordance with the provisions of laws and regulations in the field of state finance.

In addition, paragraph (5) of the same article explains the provision of health services if the vaccination participant is a non-active participant of the National Health Insurance program and, in addition to the participant of the National Health Insurance program, is provided equivalent to class III health service of the National Health Insurance Program.
