The government will withdraw all community-owned land certificates

JAKARTA – Landowners should prepare to present the original certificate of their land to the government through the National Land Agency (BPN).

The government plans to withdraw all original land certificates belonging to the community starting this year. Also, the government will replace it with an electronic certificate or also known as an e-certificate (electronic land certificate).

The Minister of Agrarian Affairs and Spatial Planning, as well as the Head of the National Land Agency (BPN), Sofyan Djalil, recently issued a Regulation of the Minister of Agrarian Affairs and Spatial Planning (Permen ATR) Number 1/2021 on Certificates Electronics

As quoted by Kompas.com, which launched Kontan, on Wednesday (3/2/2021), according to Sofyan, the purpose of the regulation was to improve business and community service indicators.

At the same time, the realization of ground services based on electronics. In the future, there will no longer be land certificates in the form of paper, all of which will be in the form of electronic land certificates or electronic certificates.

In fact, to make this electronic certificate, the relevant agencies must first validate the previous land certificates, in terms of data, land size, etc.

Once the validation is complete and complete, the land certificate can be replaced with an electronic certificate.

Subsequently, the certificates will be stored in the database electronically at their respective storage addresses.

With electronic certificates stored in the database, owners can print their certificates anytime, anywhere.

These rules are established in article 16, namely:

(1) Substitution of a certificate for an electronic certificate includes the substitution of a land book, a measurement document and / or a drawing of a flat unit plan in an electronic document.

(2) The replacement of the electronic certificate referred to in paragraph (1) must be recorded in the land book, the measurement chart and / or the plan plan.

(3) The head of the Land Office draws up a Certificate which will be consolidated with the land book and kept as a letter for the Land Office.

(4) All the letters mentioned in paragraph (3) are transmitted to the media (scan) and stored in the Database.

The regulation is signed by Sofyan Djalil since January 12, 2021.

The director of the Land and Space Registry of the ATR / BPN Ministry, Dwi Purnama, during a press conference on Tuesday (2/2/2021), explained that the implementation of land certificates in the form of electronic certificates was carried out in stages.

The initial stage is a government institution and continues to a legal entity. “Because the legal person with knowledge of electronics and equipment is better prepared,” he said.

Only then were the physical certificates transformed into electronic certificates belonging to citizens or individuals. The ATR / BPN Ministry assures that they will not withdraw the certificate by force.

Subsequently, the analog soil certificate will be replaced by electronic if there is data update. One of them occurs when there is an inheritance, donation or sale.

“Later, the concessionaire, the new buyer, will receive an electronic certificate (electronic land certificate),” explained Dwi.
