JAKARTA – The government’s efforts were handled in cash. Less than 24 hours after the announcement of its dissolution and prohibition, Front of Islamic Defenders (FPI) change clothes with names Persatuan Islam Front (FPI) . Will the new FPI register as a mass organization?

Aziz Yanuar, a member of the FPI legal team, emphasized that the Islamic Unity Front would not register as a mass organization with the government. “No (register), it wastes energy,” Aziz said via short message, Thursday (12/31/2020).

According to Aziz, organizations that do not register, are not registered and do not have a registered certificate (SKT) does not mean that these organizations are illegal. “Especially if it is considered de jure that it has been dissolved,” he said.

Aziz explained on page 125 the consideration of the Judgment of the Constitutional Court Number 82 / PUU-XI / 2013 that establishes that mass organizations are free to choose to register or not, and mass organizations cannot be declared prohibited by their decision not to register.

“According to the Constitutional Court, which is the fundamental principle for organizations that are not legally constituted, they can register with the government body responsible for that and they cannot register,” he explained.

Furthermore, Aziz continued, when an organization that is not a legal person has registered, it must be recognized as a mass organization and can carry out organizational activities both at the regional and national levels.

“A mass organization can register at all levels of government agencies that are authorized to do so. On the other hand, based on the principle of freedom of association and association, an organization that does not register with the authorized government agency does not receive services. from the (state) government, ”Aziz said.

Previously, the government announced that it prohibited all the activities of the Islamic Defenders Front and the use of its symbols and attributes. This ban applies in all regions of Indonesia. Even the authorities can disperse activities on behalf of the FPI.

“That FPI since June 21, 2019, as an FPI organization, has continued to carry out activities that violate security and are contrary to the law,” said Dr. Menkopolhukam Mahfud in Jakarta, on Wednesday (12/30/ 2020).
