Circulating a subpoena allegedly sent by PT Perkebunan Nusantara (PTPN) VIII requested the Islamic boarding school Alam Agrokultural Markaz Syariah in Megamendung district, Bogor Regency, West Java to be evicted immediately. It is known that the pesantren belongs to the Grand Imam of the Islamic Defenders Front (FPI) Rizieq Shihab.
The order to clear the land that has been built by the pesantren is sent by letter with the holder of PTPN VIII with number SB / 11/6131 / XII / 2020 dated December 18, 2020. The summons is the first and the last .

The letter explained that the land built by the pesantren by the Foundation of the Islamic Agrocultural Internship Megamendung was an asset belonging to PT Perkebunan Nusantara VIII on the basis of the HGU certificate No. 299 dated July 4, 2008.
“The act of the brother is a criminal act of misappropriation of the right to real property, prohibition of use without right or proxy and / or transfer as regulated in article 385 of the Penal Code, Peru Number 51 of 1960 and article 480 of the Code Criminal “, says the letter.
Through this letter, PTPN VIII advised pesantren officials to hand over the land to PTPN VIII no later than 7 business days after receiving the letter.
“He did not follow up, so we will report it to the Police in this case, the West Java Police,” the letter said.
Aziz Yanuar admitted that his party had received the summons yesterday, Tuesday (12/22).
“That’s right, I got it yesterday,” Aziz said.
Rizieq himself has explained the certificate status of the land where the FPI Islamic Markaz boarding school was founded on November 13. Rizieq admitted that the HGU certificate was in the name of PT. PN VIII.
However, Rizieq argued that the 1960 Agrarian Law established that if a land is empty and has been cultivated by the community for more than 20 years, the community has the right to make a certificate of the land that is cultivated.
“And the people of Megamendung themselves have been working on the land for more than 30 years,” Rizieq said in his statement which was confirmed by CNNIndonesia.com to Aziz Yanuar.
In the Land Law, Rizieq said, the HGU certificate cannot be extended or it will be canceled if the HGU owner abandons the land or if the HGU owner does not physically control the land. He assessed that PT PN VIII for more than 30 years had left the land.
“Therefore, the HGU must be canceled. If it is canceled, then the HGU belongs to the community,” Rizieq said.
In addition, Rizieq claimed that initially the Directorate of the Foundation that founded the Islamic Agrocultural Internship paid a sum of money to the farmers who cultivated the land. He claimed that the Islamic Agrocultural Internship Foundation already had the land certificates.
“So it is not confiscation. And the farmers come with a letter that has been signed by the local village chief and RT. That is what is called buying land with a garage,” Rizieq said.
Rizieq said the Pesantren Foundation board was ready to hand over the land if the state needed it. However, he sought compensation for the money from the family and the community that had been spent to purchase the over-cultivation of the land and for the construction costs that had been incurred.
“So that the cost of the compensation can be used to rebuild the Markaz Syariah Islamic boarding school elsewhere,” Rizieq said.
