Member of Commission III DPR RI Arsul Sani stated that the Minister of Social Affairs Juliari Peter Batubara He cannot be charged with the death penalty related to the alleged case of corruption of social assistance (bansos) in the management of covid-19.
Currently, the Corruption Eradication Commission (KPK) accused Juliari of the bribery article that is listed in article 12 letter a or in article 12 letter b or in article 11 of Law Number 20 of 2001 on the crime of eradication of corruption. Meanwhile, the death penalty is regulated in article 2, paragraph 2, of the regulations.
“If the suspicion is that the charges are only related to Article 11 or Article 12, then you cannot be prosecuted and sentenced to death, which could happen if Article 2 of the Corruption Law is applied in that case,” Arsul told reporters at the Parliament Complex, Senayan, Jakarta on Monday (7/12).
Article 2, paragraph 2, of the Anti-Corruption Law says: In the event that the criminal act of corruption mentioned in paragraph 1) is committed under certain circumstances, the death penalty may be imposed.
However, Arsul handed over the authority to use the regulation to the KPK. It’s just that the PPP politician reminded the KPK to review the legal construction if it wants to use these rules.
“Nor should we get carried away by the death penalty. We will see the legal construction, whether it is included or not, for example, the use of article 2 of the Corruption Law,” he said.
It should be noted that KPK President Firli Bahuri had relayed the issue of the death penalty for perpetrators of corruption in handling the Covid-19 pandemic.
He claimed to have warned that criminal acts of corruption during a disaster or pandemic could be punishable by death.
“This is not a game. I ask for this. If they catch someone, I ask for the death penalty. Even executed,” Firli told CNNIndonesia.com at the Transmedia Building, Jakarta, on July 29, 2020.
Meanwhile, Juliari has been named a suspect in a case of alleged corruption in the management of social assistance covid-19. He is suspected of receiving a 10,000 IDR fee for welfare.
