Bareskrim Polri investigators are investigating the relationship between Winda’s father, Herman Lunardi, and the suspect Maybank Cipulir Branch (Kacab) with the initials AT in the case of theft of funds from sports clients. electronic sports Winda Lunardi aka Winda Earl. The reason is that Herman is suspected of receiving earnings in the form of bank interest from Winda’s savings.
“All this will be corrected by the relationship between the victim, then the witnesses, between a witness and another witness there, which will also cause the investigators to excavate or ask the suspect (AT) questions,” said the head of the Office of Public Information of the National Police, Brig. Awi Setiyono at the Bareskrim Police Office, Jakarta, Wednesday (11/11).
Previously, Maybank Hotman attorney Paris Hutapea stated that Winda’s father, Herman Lunardi, was suspected of being involved with the AT suspect. Herman allegedly received Winda Earl’s savings interest of Rp. 576 million from AT’s personal account.
It is also suspected that Herman received 4 billion rupees from Prudential to reimburse the cancellation of Winda’s insurance policy proposed by AT of 6 billion rupees. Hotman also said that Herman and AT had known each other for a long time.
Related to this, Awi emphasized that the National Police did not want to respond to Hotman’s statement. According to Awi, Hotman’s general statement was included in the investigative material.
Awi said that the National Police used three important elements to obtain evidence of a triangle o triangular evidence. “The relationship between victims, witnesses, suspects, then investigation evidence, the center is at the crime scene (TKP),” Awi said.
After examining all witnesses, including victims, victims’ families, suspects, experts and others, Awi said, investigators would conduct crime scenes. The evidence found will become research material.
“I cannot transmit one by one because it will affect the investigation because it is still ongoing, it does not rule out the possibility of other suspects,” Awi said.
In this case, AT has been named a suspect. Maybank’s business manager stole Winda Earl’s client’s money of up to Rs 22 billion and then handed it over to his friend for investment. So far, investigators have seized the suspect’s assets in the form of cars, land and buildings.
Suspects of AT are charged in accordance with article 49, paragraph (1) and paragraph (2) of Law Number 10 of 1998 relating to banking, with the threat of imprisonment of 8 years or a maximum fine of Rp100 billion. Next, Articles 3, 4 and 5 of Law Number 8 of 2010 on the Crime of Money Laundering (TPPU) with a maximum prison sentence of 20 years and a maximum fine of 10 billion rupees.
The Indonesian Consumer Foundation (YLKI) highlighted the weak role of the two parties in the case of the loss of customers’ money in a bank. The functions of the two parties in question are the Financial Services Authority (OJK) and PT Bank Maybank Indonesia Tbk.
YLKI Daily President Tulus Abadi said the two parties needed to be evaluated on both their performance and their supervision. Because incidents like this show that OJK’s oversight of the financial industry is ineffective, weak, and even flawed.
“YLKI also highlighted the management of Maybank, which was suspected of not monitoring the performance and performance of its subordinates,” it said in an official statement on Wednesday (11/11).
According to him, an assessment is necessary because this case sets a bad precedent and may damage public confidence in the bank. Also, the banking business is built on trust in the community.
“Why keep money in a bank if it is not safe? And cases like this are not the first time, but they have happened several times, although with cases of different character, “he said.
YLKI asked the OJK to mediate the case immediately. Mediation is carried out in parallel to the criminal matters handled by the National Police Headquarters. Mediation is very necessary to guarantee and ensure the civil rights of consumers as clients of Maybank.
“Consumers have the right to obtain an adequate and fair dispute resolution, guaranteed by the Consumer Protection Act and other sectoral laws. OJK should act quickly to resolve this case,” he said.
Not only that, his party asked the National Police Headquarters to speed up the investigation process so that it would be clear what the problem was and who should be held responsible. It is also Maybank’s corporate responsibility to Winda Earl, who, by the way, is its customer.
“YLKI asked that the case of Winda’s disappearance not be traced as a simple individual banking case (unscrupulous). This should be seen as a systemic and comprehensive case, related to the vulnerability of the reliability of the banking system protection in Indonesia to protect consumers as bank customers, “he said.
Maybank Indonesia’s head of corporate communications, Tommy Hersyaputera, said the company presented the cases that had happened to its clients in full to the police. “Maybank Indonesia has collaborated with the police to further reveal this crime, respect the ongoing legal process and comply with judicial decisions that have permanent legal force,” he told reporters on Tuesday (11/10).
For Maybank Indonesia’s report to the police, the criminal has currently been arrested by the competent authorities and is in the process of trial in the District Court to account for his actions. “Maybank Indonesia supports and fully complies with the legal process carried out by the authorities,” he said.
Maybank Indonesia hired lawyer Hotman Paris Hutapea to be a lawyer. According to Hotman, the alleged robbery case is an old case because it has been under investigation by the Police since May 2020. “This case is not as simple as I thought, there are things that we will await the decision of the competent institution, there are things that it does not know , no? just an alleged robbery, “he said.
Previously, OJK had also opened his voice. OJK spokesman Sekar Putih Djarot called on the company to immediately take further action with depositors or savers. “Supervisors have also asked the bank (Maybank) to strengthen standard operating procedures and work processes,” he said when contacted by the Republic on Monday (September 11).
Not only that, OJK reminded the company to immediately conduct an investigation into allegations of fraud by unscrupulous bank employees. OJK will also evaluate and also request companies to improve the internal supervision system of banks.
“So that in the future banks can avoid fraud committed by unscrupulous banks,” he said.
